applied for new work permit extension last year and it got denied due to expired lmo (which i didnt know was expired)
now my boss beeing so upset that he basicly told me that he doesnt want to sped the time (3 monthish) to apply for a new lmo
which basicly means he let me go i guess

what to do now ????
ive been here now 8 years got a house to pay for and what not !
could i get a open work permit and start somewhere out of my current trade (automotive mechanic) ?
i just got settled back into here after moving and was on my way to get all the papers done for the cec program and now im stuck workless with no work permit :9

the 6 month allowance to remain in country is that actually counting as when my work permit expired or the date when i recieved the letter that the extension got refused ?
can i remain in canada while a new work permit application is in progress and just stay allive with ei ???

i did find a few local companies that would hire but none of them really wanna deal with all the lmo stuff

There is no six month allowance to remain in the country after a work permit has expired / a work permit extension has been refused. If your work permit has expired and the extension has been refused - then you are now out of status.

If your work permit has in fact expired, then to get yourself back in status you need to apply to restore you status (restoration of status) and also apply to change your status to that of a visitor within 90 days.

If your work permit hasn't yet expired, then before it does, you need to apply to change your status to that of a visitor.

Based on the information you have provided, you don't qualify for an open work permit. Once you submit your CEC application and receive AOR, you will qualify to apply for an open work permit provided you still have a valid work permit at that time.

so i have to leave the country right now ?
i was told i could stay as a considered tourist for up to 6 month with my passport

i cant restore my status due to the fact that my old employer wont provide me with a new lmo since he doesnt want to do a renewal of the old lmo
so in other im looking for a diffrent job right now

i havent submited the cec application yet i was working on all the papers and was gonna send it out but now i need to work on getting a new job and all this stuff figured out to be able to stay here legally and earn money again

If you ENTER Canada on your passport, then you are allowed to stay as a tourist for six months. However if you are already in Canada - this doesn't apply. If you want to trigger the six month visit, you would need to physically leave and the re-enter Canada. Note that whether you are granted a six month visit or not is up to the immigration officer you encounter at the border.

Yes - you can restore your status. You don't need an LMO. You can apply to restore your status and change your status to that of a VISITOR.

so if my permit expired on 12/11/13

and i got the mail saying it is denied on the November 19, 2013 even though i actually got this message at the 29th of december but its labeled on the top as 19th november

i will have 90 days from 12/11/13 to change my status ? or 90 days after 19 of november ?


if i apply for visitor how long would that allow me to stay and look for work ?

i got multiple job offers in the oilfield but noone there really knows what is required to hire a foreigner and im getting questions ask that i cant answer

i mean u start as a grunt in the field and work your way up ... so how would you apply for something like that to get a work permit ? thats why i thought i could go the open work permit way start working in the field and than get my cec going

90 days from the time your work permit expires.

Hard to say how long they will give you as a visitor (whether you're approved and for how long is up to the visa office). However this should buy you at least three months since this is how long it should take for the application to be processed.

The employers need to get an approved LMO if you want to apply for a work permit. It doesn't matter if it's a grunt job or not. The LMO is still required.

Open work permits are only granted in very specific circumstances. These circumstances are listed here:

so basicly no matter what its gonna be half a year before i could work anywhere ?!?

new employer needs to get lmo (3-4month)
than when he has it i need to apply for work permit for that emplyer (3month)

The LMO will probably take three months once you factor in the 1 month advertising requirement and the 2 month processing time.

The processing time for in-Canada work permit applications is relatively short if you apply online:

so at this point its basicly down to


apply for change of status to visitor (to be able to stay here)
find a employer thats willing to get a lmo
apply for work permit with new lmo


correct ?


if i do get visitor status can i leave the country and reenter or would i have to remain here the entire time ?

Yes - your summary is correct.

You can leave Canada. However if you leave the country then your visitor status is lost. When you re-enter Canada, you will be entering as a brand new visitor and will have to pass immigration inspection just like any visitor would.

imigration inspection ? what falls all under this ?

im just thinking to maybe go home for a bit visit family due to the fact that when im working i wouldnt have that ammount of time off to see the family back home

but also dont wanna go visit come back and not getting back in when im at the airport
