hey guys
i just found this forum and read some of the posts.i reaaly need some information.
my pr card got expired in dec 2011 so i came to canada 1 month before that and applied for prcard renewal.but i have been here for around a year and a half in total.my lawer told me they r gonna send ur prcard cuz u have a good reason for ur abscence.the reason is that my family landed here in 2006 and that time i was a student at university so i had to stay in my country to finish my studies and then come here,but my university period was 7 years so i have 1 more year left and have to go backhome.i am reaaly under too much stress cuz i have left my project and my studies back in my country and witing here for my prcard and everyday checking my status and mailbox but no news yet.call centre just tells me that ur case is underprocess and u should wait.
i have read here that its a mistake to send ur application before u have the residency obligation,but what happens in my case?i have sent all my university documents to them and asked them to send my prcard earlier,is there any chance to get my prcard earlier?i called to the call centre and asked to send them my ticket which is for 18 jan,the gave me the fax num and i sent it 1 month ago and didnt recieve any news from them.
is there anything i can do?i cant wait here longer and cant take the risk to go back and come with travel document(i dont see the residency obbligation and my country is not safe to take that risk)
plz let me know if u have had such a problem and anything i can do

i'm waiting for ur answer,plz give some information.does the questanare take so long for all cases or there r some differences according to the reason u have for being absent here?
i really appreciate ur help

You only applied in November and renewing a PR card takes 5 months normally so even if everything is ok with it, you will likely not see it until April. However, since you do not meet the residency requirements, it may take much longer for you because they might decide to interview you to establish whether they should allow you to renew your PR card without meeting the requirements. I do not agree with your lawyer that studying outside Canada is a good reason to not meet your requirements. At the time your family immigrated to Canada, you must have had 6 years left of a 7 year program. That means you only did one year so it would have been fairly easy for you at that point to transfer to a Canadian university.

What you can do now is either wait and see and stay in Canada as long as it takes or you can leave even if it may mean you lose your PR. If you apply for a travel document and are refused, they will revoke your PR but if you are still a dependent student at that time, your parents can sponsor you for PR again. You must however stay a dependent student until the time you get your PR issued so if you graduate from your program before that, you must enrol in something else.
