Under Work permit but laid off, now working new employer who sponsors me

Pls help ! My original work permit was with another employer. Started working to new employer without new LMO. But new employer offers me now job after working for him for a year without changing condition for new employer. Will I have a problem on my PNP approval?

Well you have been working illegally for the new employer. So you are actually ineligible for a new work permit and are subject to removal from Canada.

Me and new employer didn't know the consequences of what we have done. Would it help if I resign now, go back to Korea and let employer apply for PNP while I am back in Korea? If I resign now, how do I restore from WP to Vistor's visa? Or would it be better to resign and just go back to home country for a vacation. Have a multiple Temp. visa until April 2010 anyway. Come back as visitor again? Please help, now I cannot sleep. I am so confused.

How could you think it was ok to change your employer without getting a new work permit? I think you should talk to a lawyer.

You could try having your new employer apply for an LMO for you and a new work permit and hope that immigration doesn't check your tax records that you have already been working for him for a year. If your LMO is not approved, you can ask the employer to apply for an AEO and use that to apply for PNP. You will definitely have problems if they figure out you have been working illegally.
