U.S visitor visa expires.

Guys please help.

I am a U.S citizen and working on my PR application. I haven't receive FBI's background check yet so I cannot submit my PR application.

My 6 months visitor Visa is expired in April ( next month) Instead of filing for an extension I plan to just leave Canada for a couple weeks then come back, hoping the border will give a new stamp on my U.S. passport. I don't want to file for an extension mainly because I don't want to pay for extra fees and having to wait for approval.


Anyone has similar experience can share with me? What's the chance for border letting me in when I come back?

Apply for an extension, it only costs about $100. Currently they are taking 5 months I think to process but you will have implied status. If you go to the border and they find out you are filing for PR, then they may not let you in through fear of you working illegally or not leaving if your app is denied. If you do decide to just go to the border, make sure you show ties to the US, own a house/rent, job etc.

this is not true for us citizens (and most visa exempt visitors). actually, for us citizens, having a PR application submitted (or at least 1 fee paid with proof of intentions to submit) actually HELP a person cross the border. it shows CBSA that the person understands the rules and is not trying to skirt the system. this is from my experience with crossing the border as a us citizen before an during my process.

While a short stay in the us to come back to canada for a longer stay is a bit risky, it is important to remember a few things:
a) you are not allowed to live or move to canada until pr is approved so it's best to use the right language when answering questions
b) always carry proof of ties with you when crossing. the best forms are recent paystubs/work contracts for a us company/clients and a lease/mortgage.
c) carrying a copy of your pr application (either completed or just started) and a receipt for at least one of the fees paid will show your intent to apply for pr and follow the rules.

there are many people who have no issue crossing the border frequently. in my experience, cbsa prefers when you spend more than just a couple of weeks back home before returning for an extended amount of time.

Also:
a) US citizens do not receive visitor VISAS, more than likely what you have is a visitor record.
b) your goal is to NOT have your passport stamped at the border. that means they are limiting your stay. NOT getting a stamp allows you 6 mos. automatically.
