I am in the pool for IEC program in Canada and I am thinking about applying for a spouse open work permit, but I am a bit confused. What if I send all documents for a spouse open work permit and in a few days get invitation to apply for IEC program? What should I do in such situation? Will they automatically refuse one of my applications? Or maybe I should wait for the final round of invitations and only then apply for a spouse open work permit? But nobody knows when the final round is announced... I hope somebody has been in a similar situation and will be able to help me. Thank you in advance!

don't see a reason for 2 applications - although dual intent concept dont apply here

I would go with IEC if sure of qualifying or spousal work permit if spouse is employed on noc a,b,c

applications fee will be refunded only if processing hasn't begun - the other gets closed automatically or you may choose to withdraw

the thing is that I don't know if I will be invited to apply under IEC program, I am only in the pool and there are much more people than the number of quotas given to my country. And my spouse has a job that falls under NOC B, but I am worried that we might have difficulties proving our relationship. IEC program would be better, but I have no idea if I get an invitation to apply.

are you in a CLP - all it is - it matters what was declared as your spouse status when he/ she first entered Canada

what do you mean by saying "what was declared as your spouse status"? My spouse came to Canada with IEC program and found a NOC B job, if that's what you were asking :)

ok then I dont see an issue in applying for OWP although its discretion of VO to approve your file - not all OWP are approved - it depends on how your present your case

good luck

for me it seems that to get a work permit under IEC program is easier, because you don't need to prove your relationship... Well thank you for advice!

If you can prove 1 or 2 years minimum (I don't remember now) of Commom-Law relationship SOWP will work.

You need to fill some forms about the relationship, signed for both at the Notary, and provide documents such common rental/owner, common bank accounts/insurances.

No problem having two applications, in fact I recommend to start with your only real option now, the SOWP.

If you get ICE invitation you can decide if apply, or withdrawn one of your applications (better Don't withdrawn until have some application fully approved)

SOWP paper application process is 100 days, online 140, if you prepare a good application.

thanks for your response. I am a bit worried about proof of our relationship because we don't have any lease as we live at my parents house. But we have other evidence, such as insurance, pictures, travel tickets with our names, money transfers to one another etc. I am thinking to send paper application for SOPW and if I am invited to apply for IEC, to send an online application for IEC. I have been worried that I can't have two applications at the same time, but from responses it seems that this option is possible.

Yeah, sounds smart to provide most information possible.
A statement from your parents about you two living together can help.

SOWP paper application is faster than online.

Be sure write a clear Letter of Explanation with all the documents you can get.
