TRV Visa rejected

Hi,
I had recently applied for TRV with the purpose of visiting my husband who is pursuing phd in Canada. My visa was rejected stating the following reasons:-
1.You have not satisfied me that you would leave Canada at the end of your stay.
2.Travel history
3.Sufficient Funds
4.Sufficient documentation to support your/your host’s income and assets

I had provided the following documents for the point mentioned above:-
1.I had an invitation letter from my husband mentioning my length of stay (July’14-Dec’14) which was supported by his university as well. I am also employed in Mumbai and I had an employee reference letter from my employer.
2.I had travelled internationally twice before. My first travel was in US between Oct’2010-Nov’2010. It was an official trip. The other travel was to Nepal in Feb’2014 for tourist purpose. I had mentioned this clearly in the application. To add my US visa is no longer valid.
3.Individually me and my husband both had given our account statements. My husband had also given his tax statements. I did not provide my tax return statements but I had given my payslips. We have shown funds ~$15,000 CAD.
4.Neither me or my husband hold any asset so we did not have anything apart from income statements to show here.
Need help in understanding what exactly went wrong. And what can be the next step.

The problem was the length of the stay. A visit is something from a couple of weeks,to a couple of months, six months makes it suspicious to the officer that you actually want to come and live with your husband during his stay and not to visit him.

Also what kind of job would allow an employee to leave for six months? For sure not a job that can be considered a tie. And 15K for two people for 6 months is not enough, what did you submit as proof of future income? Tax returns are not good in this case. Were those trips to the US for also 6 months? If not those trips are going to help you little.

Consider applying for a work permit attached to his study permit. That is the correct document you want (regardless if you want to work pr not).

We actually thought of applying for work permit but since his study permit is till Mar'15 we were not sure whether applying for work permit in this scenario might weaken our case. That is the reason i had applied for visitor visa.

Do you think i can still apply for a work permit given the scenario?

I don't follow.

Weaken your case? Which case? Why wouldn't you be able to apply for a work permit?

Jalex23, wouldn't a work permit open a whole other case of worms for the applicant? LMO certification, finding an employer willing to hire the applicant, etc?

Open means that you are allowed to work in Canada in any form and with no restrictions (but the ones stated by the employer). All cans remain sealed ;)

From Canada's point of view they have already taken into account the pros/cons of approving a person's study permit. They know that the applicant might want to bring their spouse/children, therefore all those permits have a much simpler and straightforward processing and requirements. The case is not uncommon, Canada doesn't want to split families apart and are willing to help you in this regard.

If I am not mistaken on this case she simply has to send filled forms, copy of passport, proof of relationship, copy of her spouse study permit, digital photos and that's it. Can't be simpler.

Is your husband not planning on applying for a PGWP? If so, he intends to stay well beyond March 2015.....

Also, in this day and age---no one can leave their jobs for six months to visit another country.

He does intend to apply for PGP but not until the end of this year, that is why we thought we will apply for TRV for the time being.
As for the job status of mine i didnt specifically mention anything about what is going to happen after six months that might have gone wrong with myt application.

I spoke with some immigration lawyers yesterday, they were telling that i cannot apply for open work permit from india, do any of you have any links or contents which states otherwise. Also my husband does intend to apply for PR as well but all this are time consuming, we were looking for something as a quick fix.

The ones that should provide the links or contents are them, not us. If they provide you a CIC link then that is what goes.
