TRV - Spouse in Canada on PR - (Expecting a baby soon)

You can either:
1. Start the PR process right away and apply for a TRV after a few months by proving you have strong ties to UAE/your home country, or

2. Apply for a TRV (be prepared for a refusal, but who knows you might get lucky) and you can then apply for spousal PR
Thanks for your insight

Anyone whose spouse TRV was approved?

Up to you to decide but don't book your ticket and prepare yourself for a potential refusal. If you do plan to try and get a TRV you should do it asap. Best of luck.

@Bryanna -- In your earlier replies you have said NO to the medical certificate mentioning that the baby will be born on this date and the wife needs husbands assistance...Can you please let me know why?

I have decided to apply for TRV ..Do you think attaching a confirm return ticket would strengthen my application?

Thanks

As your wife is a PR residing in Canada, it is generally assumed that you will be a potential overstayer + you will apply for spousal PR by the inland route. Visa officers do not like applicants circumventing the rules instead of waiting out the PR process in their home countries.

Now, by declaring that a baby is on the way, your family ties to Canada will be two times stronger (spouse + baby). Basically, it means you will not return to UAE after your baby is born = You are not a short stay visitor.

IMO, you will only increase the chances of a TRV refusal if you declare your wife's pregnancy, doctor's certificate, etc. It's your decision though

Tickets don't prove the intention to return to the country of residence. Return flights can be easily cancelled. Also, not advisable to book tickets before visas are issued

Thanks for your reply.

But in my cover letter and the Invitation letter this is what we have mentioned as the primary reason that we are going to have our first baby and I would like to be there to witness that. I thought Canadian government promotes families being together at such times.

You are right that the visa office might think that I might not come back. But having a sound and well paid job with a renowned company, doesn't that help? I have a NOC in which the company has mentioned that I need to report back to work.

Also, should I declare any financial liabilities that I have such as Car loan, or any other loan that has to be paid before leaving my resident country.

Please advise Bryanna.

Thanks

Your wife has only recently moved back to Canada. She could have remained in UAE for the baby's birth.

I can only wish you the best of luck if you still intend to state the baby's birth as the purpose of your visit.

I haven't come across any IRCC-based information that states this for applicants in your situation.

No, IRCC does not want the daddies of Canadian babies to visit/remain in Canada until the daddies get their PR.

All these "ties" can quickly vanish once you're with your spouse and your newborn. It would have helped if your wife had already applied to sponsor you.

Yes, you can include these evidence

You mean to say that chances of TRV approval could have increased if my wife had already sponsored me?

One more question I wanted to ask if that when mentioning the 10 years travel history, do I have to mention anything before 2008. The reason is I am asking is because I went to UK on a student visa in 2006 and then converted the visa into Tier 1(immigrant visa) in 2008. So do I only need to mention from 2008 or do I need to mention the student visa as well which was from 2006 to early 2008.

Please let me know

IRCC would like to know the Travel History in the last 10 years.

You can mention your UK student visa/Tier 1 immigrant visa in your Travel History explanation. But, stating this UK stay is not a positive aspect because it was a long stay + only confirms you have a history of changing your visa to remain longer in a country, etc

Hi
I'm in a similar situation. My wife is Canadian citizen and we are expecting our first baby around mid of April. We have already applied for Spouse sponsorship and it's been over a year now with no updates. The last update was in Dec that my file was transferred to LVO.
I'm looking to apply for TRV around mid of Feb.
Please let me know if you got your TRV approved.

Unfortunately you are unlikely to get a visa although you should try. 12 months is just an estimate. Approximately 20% of cases take longer.
