TRV - Spouse in Canada on PR - (Expecting a baby soon)

HI all,

My wife is a PR and in Canada at the moment. We are going to have our first baby in February 2019 and I wish to travel to Canada at the time of the delivery. At the moment we don't have enough time to apply for Spousal Sponsorship and this is why I was thinking to apply for TRV. I am based in Dubai, working in a good company(offices around the world) and earning decent salary.I have been living in Dubai for the past 4 years and have been working for the same company.

I have a good travel history and have lived in the UK for for more than 4 years on Tier 1 visa. Recently I have been to East Asian countries as well.

I have asked my wife to provide me with the Letter of invitation (notarized) and with a medical certificate from the doctor as well confirming the delivery date.

I don't have any properties or any other ties in the resident country (UAE), however, I have a property in my home country. Should I provide them with the details? Also, I have my siblings in UAE, should I mention about them

My strong and only reason is to be there at the time of our first baby birth. Do you think this reason is strong enough for the visa office to consider my application.

Also, my wife is a student of Uni of Calgary, should I also mention that in my application and attach the relevant documents?

Any help or advice would be really appreciated

Last thing you should do is inform CIC of her pregnancy or you will likely be denied. Being at a birth of a child is not a reason for approval. You had the option of spousal sponsorship and it is also posted that average processing time is a year. You will have to show strong ties to your home country, travel history and finances and hope for the best. Given that you aren't working in your home country and seem to be moving around a lot there could be concerns that you plan on remaining in Canada.

You should not inform IRCC about the pregnancy. With a PR spouse in Canada , you are already a high risk for overstaying. Add a newborn child and you are an extreme high risk for overstaying.

It is better to start the PR sponsorship process instead of applying for a TRV.

Based on your post, your employment is your only strong tie outside Canada. You need to focus on proving you have work commitments in Dubai to return to + hopefully, your work contract is not expiring anytime soon.

Your travel to the UK will not count as travel history. Similarly for your trips to countries in East Asia.

I have a NOC from the company stating my dates of leave and date of returning back to work

So what is travel history then?

You must have your reasons for your wife not sponsoring you yet. I'm guessing she was living with you in Dubai and has returned to Canada for the baby's birth.

That said, applying for a TRV when there's no spousal PR application in process would seem like wanting to circumvent the wait times. A TRV approval is challenging but not impossible. Demonstrating exceptional ties will certainly help

You should check with the province if your wife plans to return to the UAE. If you don't meet the requirement you could be asked to pay back any costs. Does your wife currently meet her RO?

No my wife does not plan to return to UAE after the birth as she will be starting her university.

And this is why I wanted to go there and thought of applying for TRV?
But what do you suggest? What would be the better option? TRV or Spousal Visa? I know if I apply for Spousal visa I won't be able to see the birth of my first child But I would like to make a wise decision which would help me in the future.

Any opinion would be highly appreciated

You can either:
1. Start the PR process right away and apply for a TRV after a few months by proving you have strong ties to UAE/your home country, or

2. Apply for a TRV (be prepared for a refusal, but who knows you might get lucky) and you can then apply for spousal PR
