TRV refused..!! Two reason plzz help..

My brother applied for TRV on 13 January , got refusal letter 2day. VO give two reason, 1. Not satisfied for current immigration status in USA.(he is on B2 status). 2. Current employment status. (He is a businessman in our home country, funny reason becoz he is a visitor here in USA , and he is not allowed to work) . Now do you guys think he should apply from our home country again? Please guys help . I rarely appreciate your answers..

I am not an expert but the refusal for status could refer to him not applying from a country in which he has been legally allowed to reside for a year or more. How long is his visitors visa valid for? Did he show how his business was continuing back home in his absence?

Thank you for your reply..His visa is still valid, he got 6 months stamp when he enter USA, which will end on 10th April 2014. It'll expire on 2018. No he didn't show anything how his business running now. Do you think he can apply from our home country,when he goes back.? Please reply.

The rationale is that the VO has to be convinced his need to leave Canada is greater than his desire to stay. An effectively unemployed person visiting another country doesn't present a strong case for having ties to their home country, apart from being able to show a positive travel history which IS good. Be sure to include assets and social ties. Make it a strong application. Get GCMS notes to find out reasons behind refusal. There are lots of threads on forum about ordering notes. Good luck.

It is pretty much what Pippin said already.

First, you need to apply from home country. Secondly, you need to show his business / work status / assets that make a strong case for his return. Thirdly, you need to show a purpose of visit to Canada.

Once you get a refusal, you should get notes, thoroughly cover and justify on paper the reasons for refusal - the second time you apply, with supporting evidence.
