I need suggestions regarding my brother's TRV application (submitted online).
He is 26 years old, lives in India along with my parents and has a disability under the category Mental Retardation - moderate. His application has been refused today citing the following reasons.
• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR,
1. based on your travel history.
2. based on your family ties in Canada and in your country of residence.
3. based on the purpose of your visit.
4. based on your personal assets and financial status.
Summary:
My parents & brother live in India. I created an IRCC account for my father and mentioned that he wants to bring more people (my mother & brother) to Canada. My father is the primary applicant and my mother & brother are secondary applicants.
They all gave their biometrics together after TRV online submission. Finally, my parents applications have been approved and my brother's has been refused.
I was unaware that I need to submit to a separate/independent application for a person who is 22 years or old or it is needed to prove his financial dependency on my parents since he is disabled. So I didn't mention my brother's physical/mental status & financial dependency on my parents anywhere in the application. I just submitted his IMMI 5257e, Family Information & Passport copy and a digital photograph. There were no other supporting/ optional documents attached to his application.
However, I did mention that he is actually 'Self-Employed', because he went to a special school, took vocational training and is involved in a very small-scale paper-products unit (with support from my parents), but its not a substantial income (just a daily activity to keep him busy). He is still dependent on my parents financially, needs physical/mental support from my parents for his daily activities. (May be, I should have mentioned him as a 'Dependant')
Now, I want to reapply for him and would like to know how to proceed. I am looking for points that I need to keep in mind before submitting another TRV application. Below are some questions that I have.
1. I can prove his status. He has a certificate from Government that says his mental disability. He has a conduct/ transfer certificate from the school he went for special education/vocational training. He has a bank account on his name. However, his small-scale unit can't be counted as a income source, he is still dependent on my parents. So, in the new application, can I say he is a 'Dependant' and have a proof of financial support from my parents? Does it conflict with 'Self-Employed' status that I put in the refused application? I can also provide financial docs of mine & my husband. We both are Software Engineers.
2. What are the other documents that I will need to gather?
I want my family to visit me. My parents can't travel without my brother. PLEASE HELP!!
