Hello everyone, We are a PR couple from India. We have landed as Canadian PRs in March 2016 and our PR cards expire in May 2021. We have stayed for two weeks during initial landing and returned. We were having infertility issues and required to have treatment in India. We have undergone treatment in India and our first son is born in March 2017. Subsequent to that, We lost another boy during pregnancy in February 2018. In January 2019, I have applied for my son's TRV and embassy asked to apply TRP, which I did. Later it was rejected stating that TRP is already issued to the applicant. I have written back to Embassy mentioning the fact, but, never received any response from them. In the mean time, after going thru infertility treatment, we were blessed with a second boy in September 2019. Both of my boys are Indian citizens. All four of us are having US visitor (B1/B2) visas.

With my first son's TRV and TRP experience, I prefer, if possible to go to the US/Canada land border and seek my son's TRV visas to Canada. Is it an Option for us. Does the border allows Indian PR parents to seek TRV / TRP for minor children. My first son is 3 years old and the second one is 6 months.

Please let me know your experiences and thoughts on this. Thank you.

No - absolutely not possible to apply at the border. TRVs/TRPs for Indian citizens are not processed at the border. They must obtain them in advance if they wish to enter Canada.

1. Also unlikely to be issued, since they have only spent 2 weeks in Canada since 2016. No way they can meet RO.

Thank you all for your views. My wife's case is a very complex one. I couldn't share those in the forum. But, it is a complex one. We are blessed with a boy after 9 years of marriage. We have applied for boys visa to come well within the time to return back to meet RO. Then, TRV and TRP processing took 10 months only to tell that it was already issued, which they have never given. By then, we have passed RO timelines and wife is already carrying second one and couldn't return back. Now, for me the only option is myself returning and present the facts at border (if asked) and see how it goes.

Canada’s fertility doctors have access to the same knowledge and expertise than in India so it would be very hard to argue that your wife needed care that was only available in India. Your only option is to enter and see if you are reported. You are required to meet the 2 out of 5 years from your landing date. You can’t sponsor your children until you become compliant with your RO. TRP are often issued with an expiry date so it may no longer be valid. You can certainly attempt to get TRVs or TRPs for your children but that may be difficult given that you don’t meet your ROs. You will have to purchase private healthcare for your children for the next 2.5-3 years until you become compliant with your RO and can sponsor your children. Some provinces and school boards will want proof of PR to register as a domestic student. This will all depend on whether you can enter without being reported and whether your children can get TRV/TRPs. TRVs/TRPs will take longer to process due to covid. If your children get TRVs/TRPs it may be difficult to find a flight and get on a flight. Would warm you that at this time there is very little hiring going on and we will be in a recession. You’ll need to be in a position for potential longterm unemployment.
