Hi everyone, need your help please.

My mother applied in Karachi on paper on 9th May to visit my chacha, dad's first cousin in Canada.

My father passed away a few months ago, and my mother who is a teacher wanted to visit during her summer vacations for 28 days. We attached her pay slips, property documents in her name, salary bank details, employment letter, travel insurance documents, travel history (she travelled to America 10 years ago for one month, had a single and multiple entry visa back then), details of my two brothers (one is studying the other is working but she supports the fees) to show she has her sons to return to, my uncle's documents, invitation letter, bank and salary details, statement saying he will support her for ticket, accomodation and living expenses, etc, proof of relation in terms of pictures from the time she got married 30 years ago to now from my marriage to show how close they are. We also attached a cover letter to explain the whole situation, the relationship with my uncle, how she has a permanent job and sons and property to return to, and all details of the attached documents.

We got the refusal letter today which is such a huge blow. Reasons for refusal are:
- travel history
- family ties in Canada and in country of residence
- personal assets and financial status

We are so upset because all these reasons are invalid and we provided enough evidence for all of these. Is there any way we can appeal?

What do you all suggest we do?
If we wanted to reapply when we can do that?

That is quite unfortunate. Perhaps you could begin by ordering GCMS notes to see the real reason for rejection.

Thank you for replying simplyaddo. Can you tell me where to find the process for requesting these notes and the cost?

Hi,

Sorry to hear that your mom was refused. An appeal will not help. You can reapply.

1. Maybe you should have invited your mom instead of your uncle

2. Were there any large, last-minute deposits in her bank account shortly before she applied?

3. Finances: Was her bank balance sufficient to pay for her ticket + about CAD 1000 per week of visit?

4. Apart from her bank balance, did she include any financial investments (either locked-in or possible to liquidate) + pension funds?

5. You should get her property valued either by a CA.... or a self-assessment for the current indicative market value with supporting evidence

6. Do you have any other immediate family who live with your mom and brothers?

7. She must include a leave approval letter stating she will have her job when she returns

IMO, your mom has a good case..... don't lose hope

Thanks Bryanna. I am based in the UK.

My mom had sufficient funds, we showed the rent agreement for the property she owns along with proof of the rent deposits in her account. She lives with only my brothers in our own apartment which is currently in my father's name. She doesn't have details of her pension funds but there were funds going in and out of her accounts when my father was hispitalized to pay for medical and later funeral expenses as well as amounts to settle his credit card balances to have them closed. We explained all this in the cover letter. She also included permission of leave from her employer, along with a travel insurance document that was only till the end of July 2016 to prove she would come back.

Hi,

It seems like your mom has a strong application.... however, to understand why your mom was refused for finances:
1. Were there any large, last-minute deposits in her bank account shortly before she applied?

2. Was her bank balance sufficient to pay for her ticket + about CAD 1000 per week of visit?

3. Does she have any financial investments (either locked-in or can be liquidated)?

For a TRV, the applicant must prove that s/he can pay for the visit.... although the host may provide accommodation and take care of living expenses.

When she reapplies, she can include a legal will/legal transfer to show that she has inherited your dad's property + submit self-valuations of both properties and quote these market values for her property ties.

BTW any documents (maybe property ownership) which are not in English must be translated into English by a certified translator

Hi Bryanna, she had sufficient funds in her account, no last minute deposits. She has no liquitable assets, apart from jewellery. I wasn't aware you need to submit market values of the property too?

All documents were in english. We also submitted my father's death certificate and said the reason for visit is for her to have a change of environement during her school summer holidays.

Can you also please guide me how to order the GCMS notes?

Many thanks

I wasn't aware you need to submit market values of the property too?
The current indicative market value will be much higher than the purchase price of the property.... in most cases, property rates appreciate over time.

Hence, it helps to submit the property ownership documents + the current indicative market value (with supporting evidence).

Also, you may want to stress on the fact that there is no mortgage.... if it is the case..... because this will show a strong financial situation.

Your uncle can order GCMS notes:

Thanks Bryanna. We did state there is no mortgage on the property or the house and there was a document that also confirmed this. Also submitted the latest tenancy agreement. Forgot to mention we also provided booked airline tickets.

I will ask my uncle to apply for the GCMS notes.

We're really upset because we wanted her to visit during the summer school break. Now even if we reapply immediately it will already be mid July and her school reopens on 1st August. So frustrating.

We haven't received any email for passport collection yet. Will we get one at all? Or should my mum just go to collect it? We got the refusal email on 7th June.

You may want to check with VAC Karachi if they have received your mom's passport from the visa office. You can then pick it up from the VAC.... in case you have not opted for a courier service to return the passport to your residence
