TRV for my wife working in US

Dear Members,

Need urgent suggestion from you all.

I am an Indian citizen who has recently got a PR and am planning to land in April 2016. My wife is working in US on a J1 visa. I will be processing her sponsor application as soon as I settle down. I want to get my wife's visitor visa so that in case she gets free from her work before her PR is processed, she can come and live with me in Canada on visitor visa till her PR gets approved.

I have a few questions:
1. Is TRV and Visitor visa the same?
2. Does TVRs get denied if they get to know that a person's spouse is a PR?
3. For what duration the TRV would be stamped for?
4. Should she get her visa before I land (considering we don't disclose my PR status)?

Please suggest. I am in big dilemma and need to take informed decision urgently.

Hi,

You must inform CIC about the change in your marital status before you land.... otherwise you may never be able to sponsor your wife in the future + your PR could even be revoked for misrepresentation.


To answer your questions:
1. Yes. It's the same.

2. If there's an ongoing spouse PR application, TRV refusals are pretty common. In any case, your wife MUST mention about you in the Family Information form for her TRV application..... whether before or after you land.... so the visa office, will get your details.

3. The immigration officer she meets at the POE will determine the duration of visit. Normally, it is 6 months. It could be lesser sometimes

4. Defer your landing. Inform CIC that you are now married and apply to include your wife in your PR application

Hi Bryanna, Thanks for the response.

I was married at the time of application as well. I had correctly mentioned this thing in my CIC application too.
1. Currently she is in US. Informing CIC, would that not require her FBI certificate, IELTS score, ECA etc?
2. In above case, would my PR be on stake?
3. Someone suggested me to apply for her TRV now as a tourist and she might get a visa for 5-10 yrs (6 months at a time) and in case she wants to move to US before her sponsorship application is processed, she can live with me on TRV.

She will have to get PCCs/FBI certificate for her PR application. IELTS and ECA are not required for Spouse PR under Family Class Sponsorship.... it is necessary for PR applications under Express Entry.

If you had applied for your wife as part of your PR application then both of you would have received your CoPRs at the same time.

What did you mention your wife as in your PR application: accompanying or non-accompanying?

I have got mixed response. I am not sure what is the correct approach. The confusion is still as it was.
