Hello

I was just wondering...what are the chances of someone being refused a visitor extension of 6 months while they have a inland sponsorship application and owp application pending? My wife and I applied for inland sponsorship in early August and still have not heard anything (no aor). She's from a visa exempt country and her visitor status expires Nov 16th so we decided to extend her temporary status by 6 months in case cic decided to return her application after Nov 16th (meaning she could lose implied status and be out of status)... Question now is can they decline her since we don't have proof of her inland + owp apps? I read some cases where ppl were denied extension and issued a departure order...will cic be able to see that we do have pending applications even though we haven't received aor?

If she had legal status when the application was sent, and OWP app was included with the inland app, then she has implied status here for duration of PR processing time. There is no need to apply for any extensions as long as she doesn't leave Canada during processing. Staying here on implied status is perfectly legal.
The result of any status extension you submitted during this time, would be irrelevant.

Thanks for the reply Rob. We had sent the application to extend her temporary status about a week ago. The reason for that was that if her application was returned after Nov 16th she would lose implied status therefore would be ineligible to apply for a owp until aip... Just wanted to have legal status all along and leave no place for gray areas. But reading some threads I see that some were declined extensions and ordered to leave? Would cic in vegreville be able to see that we have an owp and sponsorship app pending? I didn't think of including receipts of payment with the extension app...

Sometimes CIC returns applications, but still allows you to keep implied status as long as you re-submit with necessary corrections within a certain timeframe. Though you are right, there's always the chance they will return an app outright and demand you start from scratch again.

If the inland PR app has not been officially logged into the CIC system yet, then the VO processing the visitor extension app may not have visibility on the PR app yet. Or they may simply not do routine checks to see if visitor applicants also have PR/OWP apps in progress. Either way though, if visitor status extension is denied and you get an order to leave Canada, at that point you could then indicate you had already submitted a PR app with OWP, and have legal implied status pending on the OWP decision despite the extension being denied. CBSA would not make moves to deport you in this case once they've confirmed this.

I see. So this way if let's say my application for pr and owp are returned after November 16th (which is when my wife's visitor status expires) and we have not heard anything back regarding the trv extension, I still benefit from implied status because I have a pending trv? If the extension is denied, will it have a negative impact on the pr or owp? Sorry for blabbing so much this CIC stuff drives me nuts.

Why are you so concerned your PR app will be returned to you, did you rush through it or not check it properly? Seems like you are worrying a lot over something that most likely won't even be an issue. I would just be confident your PR app will be accepted, or worst case they will simply ask you to send in some updated docs or additional info.

Paranoid I guess...reading all these threads doesn't help either lol We took time to complete and check everything thoroughly.
