TRV denied, applied for PR and now need your assistance...

Hello All,

The TRV for my spouse was denied, so we applied for PR (Out Side of Canada). If we apply for TRV again and get denied, will it have an impact on the PR application ?

The initial TRV application was denied on the grounds that she did not show sufficient proof that she will return, so if we apply again and now also include the CIC document that I got approving my sponsorship, will that add more weight ?
(I should point out that we submitted almost all the documents that is required for TRV(Proof) when we first applied, but I guess the visa officer figured that since she was going to join her spouse that she will not return.)

Further if she applies for a TRV and they see (Immigration) that she has applied for PR will they then maybe experdite her PR application ?

Appreciate your response\experience.

Given that she applied outland, it likely will not impact your PR application. It was denied because she shows no intent to return (PR app in process) so including sponsorship is only going to tell them that you vow to support her, but nothing about her intent to return. You could try supporting evidence that she will return if her PR happens to be denied (ie plane ticket home). How far along are you in the PR app process?

They definitely won't do that.

Thank you BD for your quick response. It has only been about a month and a half since we submitted for PR.

When we applied for a TRV the first time we did provide a return ticket.

Hmm...not too familiar with TRV while outland apps are in process, tho I have heard of some people who had them go through...

You are a month and a half into your outland app, and depending on where your spouse is from, you might be well on your way to getting PR (I know the outland apps are going through pretty quickly for most places). You might have to just wait it out.

She is applying to immigrate, so the PR application will be additional evidence that she won't return, making it even more likely her TRV will be refused. Don't waste your money on another TRV application, is my advice.

I AM PR SINCE MY WIFE IS ARMY OFFICER IN PAKISTAN THEREFORE I CAN NOT SPONSOR NOW I WANT HER TO VISIT ME IN CANADA CAN SHE APPLY FOR TRV DOES TRV PUT ANY EFFECTS ON HER FUTURE SPONSORSHIP APPLICATION WHICH I AM PLANNING NEXT YEAR ON HER RETIREMENT

If she is refused a TRP, this will be noted on her PR file - and in general, it is not a good thing. The visa officer looks at prior attempts to go to Canada with suspicion. However, because she wants a TRP to visit you, it should be OK.

Hi Lands.

We did almost the same as you. Applied for a TRV for my gf at the time and was denied. Later after we were married we applied for PR. Once I had sponsorship approved we applied again for a TRV and took the application very seriously. First time maybe we didn't take it serious enough I will admit. Anyway we were approved for the TRV at that time.

Things that seemed important to include was to mention the fact that the PR was in process and that Sponsorship was approved and I even gave the case number for reference. Beyond that you still have to prove that she will return home so be sure to include what proof you can. Job at home, apartment etc. In my sponsorship letter I even made sure to mention that "she will return home to wait for correspondence regarding the PR application and it's completion". Just to show that we understood the process even. Letters could be sent to her home there to request for more information or request for interview or even passport so mentioning you understand that shows you know and intend to follow the rules.

We also listed why she was visiting...ie:meet family here for the first time...investigate where we will live once she arrives...basically giving a detailed plan of her visit. I tried to show I put thought into the plan to show it wasn't just a simple visit...to show it was more important than that.

And while some say that having a PR in process can make getting a TRV more difficult...it could also be taken as a positive indication that you are trying to follow the rules and do things the right way. You have applied for PR...and gotten past the first step and some of the waiting period...if she comes to visit now and overstays you would just be screwing up your PR application. Who would be dumb enough to do that?

So three things...
Mention the PR and Sponsorship.
Provide as detailed a visit plan as possible in the letter.
Mention she will return to continue the PR application process.

Very good advice from Frolic. Nice organization of your TRV app!

Lands, the likelihood of success of another TRV application is low, even following everything by the book. But if you are careful, precise and show evidence that she will return (job!!! with letter from her employer indicated approved vacation leave) and anything else that "ties" her to her home country as well as other visas she's received and complied with from other countries, you will have a greater chance of success. Think positive but prepare for the worst.

No, applying for and being refused a TRV is not going to have a negative impact on the app for PR UNLESS there is something untruthful in the TRV app or that would make a VO think you are trying to hide something. Misrep by ommission. No good. But sounds like you were perfectly honest so no worries. You can use a TRV refusal to your advantage for spousal sponsorships because if questioned about it, you say we were trying to be TOGETHER!

No expediting.

To poster interchanging TRV with TRP, careful. These are not the same.

Update... we decided against applying for a TRV. Instead we applied for PR...She is a student and she was on her study break..the only thing we could show was the fact that she had to return to complete her studies..but in this modern age where you can pretty much be anywhere in the world and complete your studies we felt that it was not going to fly...So we are now waiting for the PR to go through..it is in its second stage(PR)..and she has already started her final year..so no rush...thank you again for all who responded...
