TRP to OWP???

Hi,

Who is eligible for a Temporary Resident Permit? We are thinking of having my husband apply for TRP but his english is very, I mean VERY weak. So will it work?

If you get to enter Canada on a TRP, is it possible to change it to Open Work Permit? lets say he works as a pizza delivery man or whatever petty job, will he qualify to get OPW?

If yes, how?

Is your husband currently inadmissible to Canada due to a crime? TRPs are for people who are in this situation and don't qualify for a TRV (temporary resident visa). TRPs are typically quite difficult to obtain - you have to prove that you have a real need to be in Canada and this need overrides your criminal inadmissibility.

If your husband is not criminally inadmissible to Canada - then he doesn't quality for a TRP and needs to apply for a regular TRV.

I just looked through your historical posts and see your husband is or was recently in Canada on a TRV. Your husband is not eligible for a TRP.

The only thing your husband might qualify to apply for is a work permit if he finds an employer who can get an LMIA for him. However, since he already has a history of overstay, it will be very hard for him to be granted any kind of temporary permit.

I think the OP's husband went out of status in June. So it's too late for him to restore his status from within Canada or apply for a work permit. He would need to leave Canada if he wants to become legal again.

Yes, he would definitely have to leave if he wanted to apply for a work permit.
