hello - i took the oath sometime back and will be getting my Can passport soon but an urgent matter has come up in india and i need to fly out there in the next month or so . And in that time frame i dont think i have enough time to surrender my indian passport and get an oci . so i guess my question is can i travel on my indian passport ( the travel is in the next 30 days ) and surrender the passport after i return to Canada ?? i know the consulate website says they will charge the individual for travel on the indian passport after obtaining citizenship of another country , sounds to me like they will allow the travel but make you pay for it later.

Has anyone had any experience in these matters ? your help is greatly appreciated !!

Here is the official text from the CGI office in Toronto - http://www.cgitoronto.ca/content/oci-0

The pertinent text -

3. Normally OCI cards should be ready in about 8-10 weeks after submitting hard copy of OCI application at the BLS Centre.
.
.
.
In case, any applicant needs to visit India while his OCI application is under process, he can apply for appropriate Indian visa on his Canadian passport on payment of usual fee applicable.

A Canadian Passport takes only a week or so get back under regular service, express service vary from 24 hours up and if your travel is in the next 30 days and you said you soon be receiving your Canadian passport seems to me there is no issue to worry about.

Plus if you travel within 3 months of oath ceremony, you can travel on Indian passport on a 3 month grace period.

"There is a grace period of three months after acquisition of foreign nationality (to be counted from the date of registration / Naturalisation Certificate and not from the date of foreign passport) for using Indian passport for travel."

If you travel on Indian Passport after acquiring citizenship of any other country, you are liable to pay penalty for using your Indian citizenship and passport. As per the current laws in India, you are not allowed to keep dual citizenship. Having said that, India will not entertain using its citizenship and passport for overseas travel (even to India).

From your post it seems that you are running short of funds to get an OCI. What will you do when you have to face penalty? Open this URL and see the Fees tab to check your penalty. http://www.blsindia-canada.com/renunciation_ppt.php

As per Indian consulate website, there is a three months grace period to travel on Indian passport after obtaining foreign nationality.

There is a grace period of three months after acquisition of foreign nationality (to be counted from the date of registration / Naturalisation Certificate and not from the date of foreign passport) for using Indian passport for travel.

If you fall in this category, you are okay.

1. The OP says that he took the oath "sometime back" so you can probably assume that is longer than 90 days ago.
