Transitioning from IEC Open Work permit to TFWP

Hi everyone,

I have been in Canada for a little over a year now on and IEC visa in the Open Work permit class. I have applied for EE and I am currently in the pool but my points aren't amazing (441) so I am probably going to need a work permit if I want to stay longer.

Currently my points are coming from:
- 4 year degree (Computer Science)
- Full marks in English
- 1 year of work experience in Canada at NOC Level A (I will have about 22 months by the time my visa expires)
- No Canadian education
- No family in Canada
- No foreign work experience

I am looking to supplement my points with a job offer from my current employer, and they are willing to support me in this.

I have a few questions about the process:

1. Do I have anything special that they have to worry about, seeing as I am already in the country, already have a job, and want to use this job offer for EE? (beyond what is listed here: http://www.cic.gc.ca/english/helpcentre/answer.asp?qnum=695&top=29)

2. In my research I have found that my employer will almost certainly need to complete a LMIA (please correct me if I am wrong here).
a. Does having existing employment affect how the LMIA needs to be filled out?
b. I am currently being paid under what the Median Wage for my field is ($29/h vs $38/h), does this mean that if my employer was to go through with this they would need to pay me an additional $9/h to meet the conditions of the LMIA?

3. I have also found that the TFWP has two streams that might impact me, one being the Express Entry stream, the other being the High Wage stream, I am a little unsure as to whether I qualify for the EE stream, it looks like it is more geared towards employers looking to hire a FW but who do not have a specific candidate in mind.

4. I was a bit late getting everything together for my EE profile (didn't verify my degree and spent a couple of months sitting at 284 points) and thus didn't receive anything regarding applying for OINP, am I likely to qualify for this with only 441 points? I have seen comments here about recreating my profile, is this something worth doing?

5. Is there anything else that I need to be aware of that could impact my continued residency in Canada?

1. Main thing is that your employer needs to obtain an approved LMIA. This process can easily take 4-6 months to complete.
2. Yes - generally speaking you need to be earning at least the median wage for your region or you should anticipate the LMIA will be refused.

4. You should post these questions to the PNP section of the forum. Short answer is that you might be selected through OINP or you might not.
