Looking for some guidance for my brother in law and appreciate any assistance as I have been unable to find the relevant information.
-He is currently enrolled in a DLI for English Language Foundations (ESL on SP) and will complete the program in December 2023.
-He entered Canada in May 2023 on an ESL study permit expiring July 2024.
-He has applied for and been waitlisted for a diploma program (unrelated to English) at the same DLI beginning in winter semester (January 2024).
-He has also applied for the same program and been accepted for Fall Semester 2024 (September 2024) in the event he does not clear the waitlist in January.
Questions:
1) If he does not clear the waitlist and will begin his diploma program in September 2024, given that he will finish his studies in December 2023 and has validity on his SP until July 2024 (or 90 days from when studies finish), is he able to stay in Canada and apply to extend his SP with a LOA for his studies in September 2024? Or will he need to leave Canada within 90 days and reapply for a new SP with the new program information?
2) He wants to stay in Canada while he waits to begin his diploma program (8 months while he will not be studying), if the above method does not work are there any other avenues we should explore outside of a visitor visa?
3) If he successfully clears the waitlist for January 2024 semester and can begin the diploma program does he need to apply for a new SP given its a completely different program, or just notify IRCC of the change?
