Hello House. I want to share a concern that's really bothering me. Kindly share your advice as it will really help in making our final decision. My husband travelled to Canada on a tourist visa last year in August. He was able to change his status to a study permit through an immigration agency. Me and our kids are supposed to go visit him as soon as his study permit is out as he will be the one inviting and sponsoring our travel. The problem here is that the agency that helped him secure his study permit within canada has asked us not to go ahead with the application because he has not yet started class. His resumption date is in October and the agency said he should have attended classes for some time before me and the kids can start with our tourist visa application. They advised that if we lodge the visa application now, we'll risk getting rejected. Please House, have you had any situation like this? My husband have left us since last year August and it hasn't be easy taking care of everything without him. Waiting till October or November before we can start applying is a long time as we've already waited almost a year. Please advice me. If we have a strong application with every requirement available, can we go ahead and apply for our tourist visa even as my husband hasn't started his classes yet. Thank you so much for your advices and contributions.
 
When did he get a approved study permit? Masters? You were going to come a visitors showing funds, travel history and ties to return (job letter with approved leave, school tuition paid, investment property).

Hello. Thank you for your response. He was approved of his study permit two weeks ago. And he has gotten his SIN and all documents. He's just waiting till October to start class. He's on a diploma course not masters. For every other requirements, proof of funds, home ties and other requirements are available. We're ready to submit application. We're just not sure if we should go ahead and apply knowing he hasn't started class.

So you are not eligible for a work permit. And did he declare you on his application showing funds for 4 people (around $36k). How long is your visit? What is he doing now with income? He was approved because his ties to return are you and the children. You can try but if refused then reapply again when he graduates.
 
He only showed funds for himself during his study permit application. I just want to know if it's okay to start our application now and have him invite us and sponsor or travel even if he hasn't started his classes yet.

You can apply now. He cannot invite you. He is a visitor not a student who can work until October. No such thing as sponsoring TRV. How much are you showing? How are you proving that you will return since it is a family business and your husband went to Canada on a TRV and stayed? What country are you applying from? Given what your husband has done then you may not get approved as you have no family ties. If refused, then apply without children.
 
My family ties is our landed property and our business in Nigeria, including our aged parents. We have more than enough money for our proof of funds. I was mistaken when I said he's sponsoring. I meant he's partly funding our trv.

When does his program start? That is when he becomes a student and can start working. Property and parents are not ties to return. Processing for TRV is at least 5 months.

That's right. He cannot work until he starts his program.
