I'm a Canadian citizen and I applied to sponsor my husband from India in July. The file was transferred to NDVO in October.
I would like to have him come and visit me, if possible, on tourist visa. Because I don't know how much longer NDVO is gonna take. I need to know the procedure and whether he's got a good chance at it.
He isn't currently working at all. He was rejected study visa in 2009 due to "insufficient funds" by CIC. He also overstayed in the UK by several years. He returned to India this year and we got married in February.

So, is it a good idea to give it a shot or is it gonna be a waste of money and time? How long does it take to get a response from the time they receive the application. Will the rejection/acceptance affect my spousal sponsorship application in any way, slow it down, etc.?

Any helpful info/tips would be much appreciated.

You have almost no chance to get his visitor visa application approved. Save your self the time and the money and wait for the sponsorship application to be processed. Good luck!

Waste of money, no chance of being approved for a TRV. Did he fully declare the refusal and overstay in the app?

I did all the paperwork. I did indicate his stay in the UK but not as over stay, thinking they'd figure it out on their own.
Also didn't mention the refusal cuz thought they'd know anyway
Have I messed up? ‍♀

Did you answer 'no' when asked if he/she was refused visa in the past?
If yes, this is misrepresentation and has catastrophic consequences! And I can say, yes, you have messed up big deal!

Did you answer 'no' when asked if he/she was refused visa in the past?
If yes, this is misrepresentation and has catastrophic consequences! And I can say, yes, you have messed up big deal!
I don't remember seeing that question anywhere in the application. Do u know what form it would have been on? I will check right away.

OMG!!! I just read the whole thing. I thought they were asking about him being a refugee in any country ever.
I'm freaking out. Is there ANY way i can fix this?

Please wait for other experienced members' comments as well.
You can submit the updated form right away via IRCC webform (and send an email to the visa office handeling the case) along with an explanation letter to declare previous visa refusal and overstaying and explain that this is an unintentional mistake. After that, just pray that CIC will consider your enquiry. Good luck!

Both very big mistakes that can result in not only a refusal but a 5 year ban from Canada for misrepresentation. This is not something you hope that they "figure out on their own".

On IMM0008 in the address history section, he was required to indicate his status while residing in other countries in the past 5 years; assuming the UK overstay was within that 5 year timeframe, he needed state "Other" and state he was illegal. On IMM5669 in the personal history section, same thing; he was required to list his status in the country at the time. Given the wording for both of those, I really fail to see how you could have thought it was not lying to put anything else.

On IMM5669, question 4d very clearly states "been refused....to CANADA or any other country". Failure to declare previous refusals is probably one fo the most common reasons to be hit with a 5 year ban.

Update the forms and send them ASAP with a letter of explanation. I suggest you send them through a Webform and send the actual forms by mail to the VO.
