Canadian immigration application submission process revised - Federal Skilled Worker

Citizenship and Immigration Canada (CIC) has issued new ministerial instructions that change the way Federal Skilled Worker applications are submitted to the Canadian immigration visa office.

There are three possibilities.

The visa office to which an application should be sent depends on whether the Federal Skilled Worker applicant has Arranged Employment or has been legally residing in Canada for at least one year as a Temporary Foreign Worker or International Student and is currently residing in Canada. For those that do not fall under either of these distinctions, there is the third process outlined below.

Applicants with Arranged Employment are to submit their applications directly to the Canadian immigration visa office responsible for the applicant's country of nationality or residence (if the applicant has been legally residing in that country for at least one year).

Applications made by Temporary Foreign Worker or International Student currently residing in Canada, who have been legally residing Canada for at least one year, are to be submitted to the Canadian immigration visa office in Buffalo, New York, or the visa office serving the applicant's country of nationality.

All other Federal Skilled Worker applications are to be submitted to the Centralized Intake Office (CIO) at CPC-Sydney in Nova Scotia. As per CIC's instructions, these applicants must meet new ministerial work experience requirements. These applicants will submit a new set of forms, along with certain basic documents to the CIO, which will forward applicants who meet the basic work experience requirements to the appropriate Canadian immigration visa office abroad. At that time, the CIO will notify qualified applicants that they must submit their complete application to the visa office abroad in a 120 day period.

Those who do not qualify based on the CIO review of work experience qualifications will have their applications returned and their processing fees refunded.

These new parameters were put in place with the goal of reducing Federal Skilled Worker processing times to 6-12 months.

They do not affect the processing methods of other Canadian immigration categories.

Above is an excerpt from a Canadian immigration news that I read tonight. This was dated December 3, 2008... so I am assuming almost everyone in this post have read this already (in case not.. you can read above)

I think this is a much welcome development .. we are seeing progress and the processing times much shorter...To quote the news above(referring to FSW under 38 occupation list):

"These applicants will submit a new set of forms, along with certain basic documents to the CIO, which will forward applicants who meet the basic work experience requirements to the appropriate Canadian immigration visa office abroad",

I am wondering how are we going to go about the new requirements.. I submitted my FSW application last July 2008 and received a file number a month later. With the new application forms, does it mean that my original application submitted in July will be returned to me and I will be required to resubmit.. can someone enlighten me about this...

If you fall into the list of 38 or you had an AEO or you are already in Canada on a student visa or work permit, your application will be processed. If not, it will be returned with your refund of fees and you can try to apply again.

See http://www.cic.gc.ca/english/department/media/backgrounders/2008/2008-11-28a.asp where it says:

Retention/Disposition

* Unless the Minister has otherwise instructed that applications be retained, federal skilled worker applications received on or after February 27, 2008, that do not meet the assessment criteria described above shall not be processed, and the processing fee shall be returned.


So if they are returned if the do not meet the requirements, that implies that the ones that do meet the requirements will still be processed.

I belong to the 38 occupation list and submitted my application last July using the simplified application form, but per the news that I attached on my first post, new forms are required.

My questions is , are they going to return my old application w/c was submitted at CIC Manila and resubmit using the new required application forms directly to Sydney NS?

you mean everything? when was the new form effective, coz i just passed my application
last november but unfortunately was returned back, do u think i need to redo all my
forms b4 resubmitting it. please advise.

How long does it take to get the AOR ? Been a month, still haven't heard from CIC. Also, they have not cashed the cashiers check as of 12/06/2008. Any Insight?

Patience is virtue. When it comes to immigration, a month is nothing. Since they just changed the rules, they now have 9 months worth of applications sitting around they have to sort through.
