This is regarding my parents and sister's case - they were PR residences, but due to lack of finances/hardship, they had decided to move back to Middle East for job. During the PR card renewal time, they admitted in their form that they did not meet the residency criteria due and had to live abroad due to the reasons above. All efforts were made during the time to settle in Canada (purchased house, school records, house tax bills, etc.). The visa officer mailed a letter station "contact nearest Canadian mission when you are ready to come back into Canada". We all took this as a blanket statement that they can apply to Canada when they're ready!
Now fast forward 3 years and now my family is financially solvent to finally make Canada their home. They applied for a travel document and it was rejected due to the unmet residency requirement. This is a really hard on since my brother and I are living here while my parents and sister are back there
We really want to be united now.
We met with two lawyers - one says you should start a fresh PR process while the other says to appeal. We don't know what to do!
1. Will starting a fresh PR process be viable? Won't it be held against them that they had been PRs before? Should they relinquish their PR and start over?
2. Can the appeal process be started in conjunction with another PR application?
3. What other options are available?
Any advice would be helpful - we're really all going through a rough patch. I cannot imagine a future where my parents and sister are away from my brother and me
