Your position has to been listed on one of the job occupation listed under NAFTA agreement as well. As long as you have the qualifications for the position and education for the position listed, you can qualify for TN visa. You still need to convince US border agent that you will leave US at end of TN visa.
You are right, TN visa eligibility too has certain requirements.....
1) Candidate should have at least 2 years professional diploma from recognized US/Canadian Institution. If foreign educational certificates, that need to be evaluated by US/Canada approved agency as equivalent qualification for NAFTA category jobs.
2) US Employer should offer job (Their letter should comply with the NAFTA specific wordings, stating that the opportunity cannot be filled by local resources and its a temporary job, candidate will return to Canada......etc.
For the first timers, its recommended they use Immigration Attorneys to avoid any hassles. There were some instances where the overtly aggressive US Custom officers rejected visa, finger printed candidates that made them ineligible to work for certain period.
