Time Sensitive Implied Status Question, please help!

Hi All,

So first of all- I have just received my COPR in the mail!!! YAY! But now I am faced with one final problem!

My IEC runs out tomorrow. I sent an application to change to visitor status about 30days ago to Vegreville, so that I could stay in Canada until I found out the decision of my PR. No word was given on the visitor status, so I was understanding that as of tomorrow (Nov 19th) I would be on implied status until I heard about either PR application or visitor extension application.

I am unable to go to the border until 20th/21st so my IEC will be expired, my question is will I be covered for those two days under implied status, or do I lose that implied status because I have received my COPR??

Very confusing I know, if anyone could shed some light I would be very grateful!!

Be careful here. OP mentioned getting COPR in the mail. That sounds like he/she applied outland. You can't get COPR in the mail if you applied outland. That said, assuming OP applied outland, he/she cannot get implied status. And most importantly, IEC does not get implied status either. Nor does OP can continue working past the expire date.

OP is in Canada on an IEC and the IEC is about to run out. OP has filed to change his/her status to that of a visitor. Until the OP hears back on this decision, he/she has implied status in Canada (as a visitor).

You are correct. I had missed the line about submitting change to visitor status. OP has implied status as a visitor since change to visitor was mailed 30 days before IEC expired. Just remember that OP must quit working on last day of IEC visa.

Thank you for your responses. I will not be working for the 1 day of implied status that I need to tide me over until I get to the border. I just wanted to make sure that implied status wasn't cancelled due to receiving my COPR. But what you are saying is that until I receive a decision about the visitor extension I am covered?

That is correct. You are deemed implied status as visitor until CIC made a decision on your visitor status.

Hopefully you should also receive a refund of the visitor extension fees. We had an extension in progress when our PR came and a few months later received a letter saying they cancelled the extension applicaton because of the PR and attached a refund of the fees.

That would definitely be nice Harju! I just assumed I would lose that money, so fingers crossed that will be a nice surprise in the mail in a few months!

OP may get a refund of the extension however keep in mind, OP has 2-3 days of implied status. He cannot "land" while out of status. His status must remain valid until OP lands. So he has to pay for the "implied days" after OP's IEC expire date. Otherwise he is considered out of status. If CIC does cancel/refund the extension, CIC is effectively making OP out of status after IEC expire date while waiting to land.

It is entirely possible. But you won't know likely know this until after you land. Beside if your extension has been cancelled you would likely to get an email of this change. So don't get your hopes up for a refund. If you did get a refund it probably means that CIC has looked at your application after you land. Remember you are under "implied status" as visitor when you applied until CIC says otherwise. It is possible that you were "out of status" if they cancelled your extension because you landed. Again not your concern, you did everything by the book. If CIC is too slow to open your extension only to find that you landed, a bonus for you and you get your refund.

Your previous status isn't voided until you actually land as a PR. You will have Implied Status when you land, don't worry about that.
