Three questions regarding BOWP: Application question and Implied Status

Hi,

I am a September 4th 2014 applicant; I received my AOR January 20th 2015. I have received no correspondence from Immigration since then, but I do follow this forum daily.

My current work permit is due to expire May 10th 2016, so I am coming up to the 'within 4 months' eligibility for BOWP application - regarding which I have one question:

Do I need to include a copy of my current work permit with my passport upload? It requests you upload stamps, visas and markings, but sometimes work permits are referred to as visas in my experience. While I assume it would be asked for directly I just wondered if anyone else included it?

Second question, regarding BOWP:

If, for example, my application takes more than 4 months and I fall into the 'Implied Status' category, does that implied status mean 'open work permit' status or does it remain the closed work permit status with my current employer?

And lastly:

With the latest updates from cic and consequent confusion, would the general consensus be the apply immediately and hope my eligibility gets set to passed internally...or do I wait to apply in April/May with the hope of gaining time?

I of course intend to apply immediately given that immigration is enough of a waiting game...but I don't know what's best anymore. Seems like there's differing view out there.

Anyway, thanks in advance for any input!

2. Implied status extends your current work permit - if it's closed the same restrictions apply during implied status

3. Apply as late as possible:
- you might get PR before you need a new BOWP
- your eligibility might be set to passed before you need a new BOWP
- if all else fails you will be able to continue working on implied status for 3-4 months (and you might get PR or eligibility: passed during that time)

Hi Muskwa,

I'm a Sept 15th 2014 applicant and my work permit is due to expire on May 26th. I'm in the same boat.

I asked about the BOWP changes to a couple of different immigration lawyer, but I got the same answer from them.... it's AOR received or Eligibility passed. Unfortunately I had the perception that both of them missed the point that this is a recently changed rule, thus I want to set a face to face meeting with the one I'm officially using to clarify this issue once for all.

As you correctly stated the interpretation of this rule may drive us to apply for the BOWP right away or at the last minute.

I'll keep you posted on the conversation with the lawyer.

Dubliner74, that would be very much appreciated.

I personally believe we will receive correspondence from immigration within the next 2-3 months but it is always important to make a plan B.
