Looks like I can't apply, as only nurses are on the 38 list, not midwives. Midwifery has its own code, 3232, but I can't apply without a job offer if the job isn't specifically on the 38, can I?

Damn damn damn. Back to square one.

Have you worked as a nurse for one year in the last 10? Maybe before you became a midwife? If yes, then you can apply under the nurse code.

No, I have no nursing qualifications at all, I have a BSc Hons in Midwifery.

Ah well, back to the more complicated Family Class application I guess, not all is lost yet...

My wife has a bachelor of nursing and she has been working in a hospital as a health care assistant for the past 1 year, you think she will qualify under the nursing code?

Looking at your older posts, it seems that you have already applied as an FSW under the old rules. Are you wanting to apply again under the new rules? Because you will have to pay the fees again etc. and your old application could be close to completion depending on what country you live in.

As for your question, your wife may have the education of a nurse but without having worked as a nurse for one year, she can not apply as a nurse. If you go to the NOC website and look for health care assistant, you get this: http://www5.hrsdc.gc.ca/NOC/English/NOC/2006/QuickSearch.aspx?val65=3413 This is not even a skilled NOC.

Thanks for the information. Yes i have already applied as an FSW under old rules in jan 2008 in Hong Kong but my profession is not on the 38 list so was wondering if my wife could qualify under the new rules. It seems i am in for a long wait :-(

For Hong Kong, the average is 35 months, see http://www.cic.gc.ca/english/information/times/international/02a-skilled-fed.asp#asia so that's a little more than another year you have to wait. The list of 38 has absolutely nothing to do with applications before February 27th 2008. It is only applied to applications received after that.
