The troubles of a 20-year old spousal applicant

Hey guys!

I'm a 20 year old Belgian with a fiance (also 20) in Canada. I want to marry her this month and try to find a job before my return flight (7th of January).

This so I can stay for a year through the working permit (without being a financial burden to her), and then apply outland for a PR. But as many of you probably have been, I'm so uncertain about a lot of potentially important details of immigration laws.

My first question would be; If I send the application to Missisauga, how do they know that they have to send it to Paris (Embassy that processes Belgian applications) after she's been accepted as sponsor? Do I have to mention it on a separate form? Or do the forms speak for themselves?

I had a lot more questions than that, but I'll have to wait until they come back to be. I've done nothing but research lately, reading through the night to find bits and pieces that I may or may not need to know, and it's getting so tough. I know that this community has helped a lot of people, and it gave me hope that I too could live with the woman of my life some day.

Thanks in advance,

Brandon

Read the forms, it is question 4 on the IMM 008.

Oh, thank you! I've read so many forms to the point that I just look at the words without being able to understand what I'm reading... Thanks a lot, this connects some more dots for me.

I just remembered another question I had; If I send the application to Missisauga I might be in Canada, and my address of residence will be my fiance's apartment. But maybe I won't be able to stay because there's a chance I won't get my work permit, and then I'll have to go back to Belgium and start saving up again. Is that something I'll have to e-mail any party about?

Question 2; do I really have to send my parents and sister to the panel physician? I don't see what they have to do with it, and it looks like the process of acquiring their medical information can take weeks...

Once you have an application in process you can notify the Visa Office of a change of address through the website. I'll be moving to Canada shortly while mine is still in process and updating them then. Will you be returning on a youth visa? They're usually successful I thought.

No you don't have to send your parents or siblings to the panel physician. However if you choose not to you can NEVER sponsor any of them at a later date under any circumstances. Only people who are accompanying you and dependants should be included. If for any reasons dependants can't be included a valid reason should be given.

Good luck

This restriction only applies to spouses and dependents who are not declared to the visa office, or who refuse to be examined at the VO's request. Your parents and siblings do not need to be examined and you aren't barred by their not being examined for a future application. They do need to be declared on your IMM 5669 (background form).

Since you are married, you couldn't sponsor your siblings in any case. Parental sponsorship is currently closed although it might reopen again in the future.

Ok, thanks! And I have never heard of a youth visa, what is it typically used for?

I don't wish to ever sponsor them, and to be completely honest, they're one of the reasons I am moving away from the country, heh.

However the reason I wondered that is because of what I've read on this page:

www .cic.gc .ca/english /information/applications/guides/3999Etoc.asp (minus the spaces)

"Medical requirements

You and your family members, whether accompanying you or not, must undergo and pass a medical examination in order to come to Canada."

Ok great! Do I still need 8 pictures of them all with that though?

While not clear from the text you quoted, this is specific to spouses and dependents. It does not mean your parents, siblings, grandparents, cousins, or any other family member. I've also seen examples of the cases where it isn't true (e.g., if the visa office declines to examine them.)

So think of it this way: if you declare your parents and siblings and the VO doesn't ask for them to be examined, they aren't excluded anyway as a matter of the regulations.

You won't be able to send PMs until you have 10 posts on the forum (just as an FYI).

Brandon when they say family they mean it from a point of view as if you are married. Family= You, Wife/ common law partner and dependants. Siblings and parents are listed on the additional info. You need photo's for you and any accompanying family members, they don't want pictures of your dad who probably won't ever come to Canada.

It's a one year work visa for under 30s (in Belgian case). Had assumed it was the visa you were on now, info is here:

Oh good, that's a lot of extra costs saved right there. Much appreciated!

Nope, I'm still in Belgium now and was hoping to find a job while on my visitor's visa before my money would run out, or before my return flight (which I had booked in September, before I decided to start the whole immigration process). Thanks for this, I'll definitely look into this!

EDIT: I wonder if it would be a problem if I apply to this while being legally single, but get married in the process of acquiring that youth visa.

If by 'this' you mean applying to the youth work visa, it shouldn't matter if your marital status changes during the application. If you don't get it before you are married, you would need to let the VO know. So, I'd apply sooner rather than later so that you minimize variables.

Oh excellent, does this mean I'll be able to apply for a work permit, and get it within the next 2 months while I'm waiting for it with my fiance in Canada? And apply for outland-processed PR while I'm at work in Toronto?

I've received your message by the way, thank you!

EDIT: Apparently I'll have to stay here and wait for my Letter of Introduction. My currently my plane would take off on the 22nd of December, would I have it by then?

Other question I had; when asked for any other name (nickname, alias etc), should I give them the artist name under which I create music? If so, should I keep the other 'family name' box blank, or should I still give my family name in that specific box?

According to the timing at http://www.cic.gc.ca/english/information/times/temp/workers.asp, it is taking Paris VO 2 months to complete 80% of temporary work permit applications. You may want to check over in http://www.canadavisa.com/canada-immigration-discussion-board/foreign-workers-b10.0/ for people's experiences.

You may apply for 'outland' PR sponsorship while you are physically in Canada. The only risk is that if they want to interview you, you'll need to go to Vienna for the interview (you can mitigate the risk by ensuring you send sufficient evidence so they don't question your relationship).

And, you're welcome.
