Temporary Resident Visa Rejection

I am 53 years old. I've worked for 28 years and still working with a top Nigerian Construction firm as a Quantity Surveyor, but now a Contracts Manager since 2007 (www.agferrero.com). I'm married with 4 kids (3 including nephew that I brought up from 4 years) and own my own home and other properties.

When I received my Email of a rejection I was literally shocked, not because of the rejection itself, but by the reasons given. I can't believe that anyone who looked at my documents will ever arrive at such conclusions. I recognize the right of a Country to reject for any or no reason but at least the facts should be acknowledged.

First of all, my proposed visit was only because I thought it would be nice to accompany my nephew who I'm sponsoring to uOttawa, M.Eng Chemical, and to use to opportunity to explore Canada a little (Toronto and Ottawa). Also, it is my ambition to visit as many places as possible in my Lifetime. I'm also an active Google Maps contributor - Level 6. My pics from all over the world have garnered over 1.3 million views. I'm not desperate. So to allege that:

1. I had not answered questions in the form truthfully? I was shocked. I answered every question TRUTHFULLY as with every other country's Visa I'd ever gotten.

2. That I'll not return due to my work details in inconceivable. I manage a portofolio of contracts worth more than CAD96million. My letter of Employment and Introduction by the company were attached. contact numbers and emails for verification were clearly shown.

3. That I'll not return due to my Financial Status was simply unbelievable: CAD139,610 was available and enough for my trip (and my nephews fees and living costs for 2 years at CAD76,000) as shown by 2 bank statements, including Standard Chartered Bank. Too little or too much? I didn't expect a full personal audit of my Net Worth or I would have shown evidence of much more.

4.That I'll not return due to my ties in Canada and Nigeria! Wow! I don't know a single soul in Canada, so what ties? In Nigeria I'm married with kids; Marriage Certificate and Children's Birth Certificates were included.

5. That I'll not return due to my travel History! I have traveled USA x 2, UK x 2, Italy x 2, South Korea, Germany, Netherlands, France, Turkey, UAE in 5 years; too few or too much? I returned from every single country traveled to within my declared dates, which were, in all cases, less than the permitted stay period by the particular country's Border Control. I (with wife and 2 daughters) hold a 2-month old USA visa.

Is it possible to over-qualify? What could I have done wrong? The reasons given could have been generic, but, if so, it would be unjust and expensive, not to talk of insulting.

Are there any means of seeking redress? I'm no longer interested in the Visa per se, I just can't bear having my integrity so impugned.

How long a trip did you request?

You can appeal the decision if you wish. This will necessitate hiring a lawyer in Canada and will cost a few thousand dollars with no guarantee of a positive outcome.

Seems like you have a strong profile. Did they mention that they do not believe you have answered every question truthfully? Have you ever been refused a visa in the past? Did you provide proof of all your previous travel history? Provide details of what you plan to do while in Canada/

There have been thousands of Nigerians that have applied for asylum in Canada so this is one of the reasons you were likely refused.

It is so sad sometimes how these Visa Officers make decisions.

You can order GCMS notes to get insight as to why you were refused. Wouldn't take the refusal too personally. Refusals are very common. Canada is a very hard country to visit. What is important is that your nephew got his study permit.

Thanks for your comment. Yes. They did mention that I had not answered all questions truthfully. I was refused a visa to the UK in 2012 for a graduation at University of Liverpool (after paying USD37,000+ for an Online Masters the UK Border Agency felt I could't afford to attend graduation. Lol), but subsequently granted twice since then. I did not provide any additional details of what I planned to do in Canada save for the mention in the Visa Form. I provided proof of all my travel history.

Thanks for your comment. I requested for 15 days sojourn. I'll not go the litigation route as my reason for a visit was quite casual; no real need. I may eventually re-apply with more details.

Thanks for your comment. I clearly didn't apply for asylum and never will. I'm very comfortable here and, at 53 years old, I am not keen to start a new life anywhere else. I'm quite happy traveling occassionally on holidays. Many Nigerians do indeed apply for asylum for frivolous reasons and or attempt to enter and/or stay in Canada illegally, but profiling all Nigerians as desperate (I do not assume that this is the case) without considering individual merit is unjust.

Did you mention this refusal on your application? I believe there is a question if you have ever been refused anywhere else.

Thanks for your ongoing comments. There may be an issue there. I'd argued with my helper about this point and he convinced me that since I'd been subsequently granted the UK visa, and twice, that there was no need to mention the refusal, that mentioning that refusal may instead mislead the reviewer into thinking the refusal was still valid. That could have been an issue. I will explain this in my re-application and hope it will be taken as a benign mistake as I have no vested interest in deceiving anyone, having traveled, reasonably, extensively since that 2012 refusal.

That was the problem then. You must still declare it, plus you could have easily explained it away by saying that subsequently you have been successful in getting a UK visa and travelled within the visa rules many times. Then provide evidence of all visas you hold and all travels you have made as a visitor.
I have seen people post their application notes that they applied for after refusals, and the visa officer says something along the lines of the visa applicant was not truthful in answering all the questions, which then caused them to doubt if the remaining information is genuine. People often get banned for 5 years from applying again for not disclosing such information even though they made a mistake or did it through their agent and the agent was not aware of the refusal. Luckily they didn't ban you.

Do to the reason 12138 people claimed asylum from Nigeria in Canada in 2018 , just assume that applications from Nigeria are highly scrutinized, and any errors in the application could cause them to be refused

Thanks for your very helpful comments.

This is the problem, sometimes, when you rely on other people to fill Visa forms for you. My helper came highly recommended by a close friend and given his, claimed, experience, I was wary of going against him and regretting it. Similar thing nearly happened, (re my parents' birthdays which I didn't know because nobody kept western Calendar dates at the time of their births, Mum 98 years old, Dad late since 1969, would be over 120 years if alive. My helper had filled an arbitrary date instead of answering 'No Known'.), with my USA visa, luckily, I was able to terminate the application and re-apply myself and have been doing so since then. I will explain in my re-application and leave it at that. The rejection Email said I could re-apply at any time.

Thanks
