I am in a precarious situation, need urgent help.

Both me and my wife are on Work Permits and working in Ontario. We are expecting a baby in September 2014 and my wife's visa expires in Nov 2014.

I have my Visa valid till November 2015.

Is it possible to move my wife to my dependent visa without she having to leave the country

Will she still have OHIP benefits after November 2014 (if she moves to my dependent)

Will She be eligible for EI benefits

Is Your ocupation in NOC 0,A or B? If it is, that means its skilled and Your wife has right for Open Work Permit based on your WP. And then she's have ohip and everything else

Thanks for your reply, yes my occupation is in NOC "0".
So, I assume, I will have to apply for her Open WP before her own WP expires ?
Can someone provide the link for the Open WP requirements and procedure for applying...

But to make it simple, if your NOC code stars with 0 then you're 0 group

If the second digit is 1, then You're skilled group A

If the second digit is 2 or 3, then you're skilled group B

Or if You and Your wife have TRV you can go to border crossing at Niagara and get OWP same day. There's immigration office there, and all you need is your work permit and proof that you are married.

I got mine OWP there in 10 minutes.

Not sure in your case.. But I'll share with you mine.. I was in Canada on visitor visa, and since my husband has work permit and his ocupation is skilled all we did is went to immigration office at Niagara border crossing, and I recieved open work permit in 15 minutes. We filled the form there, and paid regular fees.

So I guess that You can do the same. The only 2 conditions are: that you are under NOC 0, A or B, and that your work permit is valid for at least 6 months

Further to what ljiljka007 has said, there is no unique dependent visa as such here. She would already have a trv on her passport (type W-1) because of being on work permit. Even if she had applied as your dependent for OWP, she would have gotten the same TRV type (i.e. i applied for myself for wp (NOC A) along with my SOWP and the visa on passport is the same type for both i.e. TRV type W-1. You need proof of your relationship AND your work permit / LMO to show that you NOC is one of 0, A or B.

If you were on ICT about which i am not clear of LMO details. But bottom line is, CBSA should be able to verify your NOC clearly. It might be a good idea to have a letter from employer which clearly outlines your duties in detail so there is no doubt about you being in NOC 0. If you want to be more cautious, take a recent pay stub along showing that you are still employed and getting paid.
