Temp Visa for Filipino Wife

First off I would like to thank all the members here. Even though this is my first post, the info on this forum has been invaluable for researching info on my sponsorship for the Permanent Resident Visa.

I recently returned from the Philippines a few days ago to help my wife fill out her Permanent Residency application documents but her passport was less than 18 months from expiry so now we have to wait a little longer for her to renew before she can DHL the docs back to me. I was reading an article that in lieu of Yolanda, the Canadian government will be fast tracking all Visa applications for Filipinos but after checking the processing times again on the Government of Canada website, the processing times as of Nov have appeared to have doubled. I am guessing that the added load of applications being passed off to Manila has caused a backlog. So instead of thinking my wife would be here by the last quarter of 2014, it appears that she might have to wait until the end of 2015.

My situation has lead me into considering a Temporary Residence Visa in the interim while her Permanent Residency application is being considered, but I have some questions regarding it. I understand that is is a catch-all for everybody wanting to visit Canada, and there are some requirements that the visitor needs to meet in order to enter Canada. Is there any special consideration given to spouses? She has no "ties" per se to the Philippines other than family. She has no money, nor a house, business or investments. If she comes, she will be relying on me for everything from food and shelter to the plane ticket. I am 31, a citizen, work full-time, have been employed in the same job for over 8 years and make well over the amount needed to sponsor her as a Permanent Resident. Will this be the mitigating factor in her acceptance for a temp visa?

I already have potential jobs lined up through friends and family for when she gets accepted as a Permanent Resident, but I figure she will need an extended integration and acclimatization when she arrives so she can do all of this while on a temp visa. So it sort of works out. We have been rather lazy about getting her here because the wait times have always been so short. We married over a year ago and there was never any rush but now that the processing times are increasing, it is sort of a wake up call and I am not sure I can wait that long for have her here with me.

To be approved for a TRV, the burden will be on your wife to prove that she has strong ties to her home country and has no plans on remaining in Canada long term. The fact she has no money, house, business or investments will certainly work against her. There is no special consideration given to spouses. Quite the opposite, the fact that she has a Canadian citizen husband will certainly work against her. TRVs are meant for individuals who want to visit Canada temporarily as tourists and have no plans on remaining in Canada long term. It's not much of a leap to guess that your wife eventually plans on settling in Canada permanently given you are Canadian.

By all means go ahead and try to apply for the TRV. However there's probably a high chance of refusal. I would focus on filing the PR application as soon as you can.

FYI - there is no minimum income requirement to sponsor a spouse for PR.

Also, the Canadian government is not fast trakcing visa applications for all Filipinos. Just those who have been significantly affected by the typhoon.

Yeah, we are apply for PR. Just wanted to get her here in the interim. Kind of depressing to think of another year but you got to do what you got to do. Good to see that people with money, count for more than people that are married to taxpayers.

we have the same situation. we applied for PR in the Philippines and while waiting for the result, i applied for a visitor visa and fortunately it was approved. so it won't hurt if you try. from what i learned from the people here in the forum, whatever the result for the visitor visa application has nothing to do with the PR application.
