Hi,

I am a landed immigrant last June 2010 but just stayed for 1 and 1 week to continue an employment contract outside Canada. Went back to last January 2011 for only 3 weeks then left again for another employment contract outside Canada. I am renting a condo for my spouse and kids in Toronto. My question is...

1. Do I need to pay tax?
2. If yes, how will I pay tax if I am out of the country?
3. If there is penalty, will I be able to go back to Canada?

Additional question, how long can I work and stay out of Canada?

1. Yes (in principle)
2. You have to file a tax return first (on or before 2 May 2011). You can either download your tax return for Ontario from the cra website or ask your wife to find an accountant or tax preparer to do/submit the tax return for you.
3. Yes, you will be able to return to Canada if you have a valid PR card. You can live outside of Canada up to 3 years in every 5.

It is quite possible that the OP is not considered a tax resident in Canada by CRA. Although if his spouse is claiming the Child Tax Credit, then she has to report his income.
 
Thanks steaky and PMM, really appreciate your help. But if I'm not able to do any of this before I return to CA what are the possible consequences?
