Hi there

I left Syria in 2015 because I'm a gay guy and because of the current affairs in Syria. I travelled to South Africa and applied for asylum. Sadly, South Africa rejected me and did NOT grant me the refugee status.
I have appealed to the court but it's been more than 3 years and I did not get a date yet.
The refugee system/program here is very poor. I have a permit that allows me to stay until the court reconsiders their decision. The huge problem is that there is no provisional date for this case and there is a huge chance that they might deport me soon.
Will i be elgible to apply for a refugee status in Canada? My plan was to apply for a tourist visa and apply for refugee status when i get to canada. I tried to contact UN but they told me it could take up to 6 years for a case to be resolved with the UN. I can't wait that long because I will get deported.

When/If I apply for a refugee status in Canada, shall I mention this problem with South Africa? This is very important that I get accepted because if I go back home, they will kill me. My name is on the wanted list because they discovered that I'm gay.

Realistically, if you have been rejected by another "safe" country for asylum, you will have difficulty getting Canada to accept you.
You absolutely must inform Canada of the refusal. It's highly likely that they will find out anyway and misrepresentation is a serious issue, possibly leading to a five-year ban from Canada.

Be aware that your chances of being approved for a TRV to Canada are close to nil given your immigration history and your current status in SA.

The fact you are currently living in a country that has a process for accepting and providing protection for refugees (whether it’s a good system or not) would quite likely make you ineligible for refugee status. You may find yourself classified as an “excluded “person, because you are coming from and have claimed refugee status in a country that affords you the similar rights and obligations of the country where you claimed. The speed of processing the application is irrelevant, as until your status is determined, you have protected status. To come to Canada during the process or abandoning the process would likely be seen as a refugee of convienience.
Also consider that coming to Canada, it is unlikely you will receive a hearing to determine if you are a refugee or protected person for about 2 years. The current backlog in the system is pushing the interview process out substantially.
