Hi
I am on closed WP (ICT) for nearly 3 years in Ontario. Currently, my spouse is having an Open WP as my dependent.

My spouse is getting LMIA offer from her employer in a restaurant. If she accepts offer, she will be on closed WP.
Based on her closed WP, can I apply for Open WP as her dependent? I want to switch my job. However, being on closed work permit, I can not switch.

So she has an approved LMIA and closed WP? Accepting offer doesn’t mean she is on a closed work permit. She needs to be approved for WP. What is the NOC? Wage?

NOC - 0,
Currently she is on Open WP as my dependent. Her current employer has approved LMIA and offered her to process for closed WP.
Before switching from Open WP to closed WP, I want to check possibility of converting my closed WP(currently as primary applicant) to open WP(as dependent of spouse) before accepting any offer.

If you are on closed work permit then continue working. Have your spouse apply for closed work permit and get approval before you apply for SOWP. If she is refused then your SOWP will be refused too. Her permit needs to be approved with an expiry of at least 16 months.

Make sure LMIA is in her name.

Thanks for your reply.

Considering, she will get her closed WP approved for 2 years. Once approved, Can I apply for SOWP?
My question was, Being a primary applicant(currently), can I apply for SOWP?

Based on your previous post this was a caregiver role for the restaurant owner just last month yet now your spouse is going to be the manager of a restaurant? There is quite a lot of fraud when it comes to these restaurant manager positions so would make sure she has significant proof that she has both the experience and/or education to be a restaurant manager and that it is a large enough restaurant to justify having a manager as well as an owner.
