Hello ,

I moved to Canada in 2017 on a intra company transfer. I am on work permit which expires on Jan 2019 with my current employer. I donot have a PR nor I have applied for one yet. There might be some layoffs in my company in next few months and I want to be prepared.

Scenario 1: If I get laid off by my current employer
  • Can I continue to stay in Canada till my current work permit expires in Jan 2019 ?
  • Is it legal to stay back and find another job and get a new work permit with new employer before my current status expires in Jan 2019.
Scenario 2: If I dont get fired and if I get a new job offer from another employer.
  • Can new employer apply a new work permit for me while I continue to work for my current employer ?
  • By doing this will it cancel my current work permit ?
  • Would my current employer know I applied for work permit with a new employer unless i communicate ?
  • Do I have an option to choose which employer I want to continue with if I hold more than one active work permit (if thats allowed) ?

Thank you!

If you are fired, you can remain in Canada legally as long as your work permit is valid.

If you want to work for a new employer, that employer must start by obtaining an approved LMIA. Once the LMIA is approved, you can then apply for a closed work permit tied to your new employer.
