Super Visa Refusal - Can I request reconsideration (refusal reason is not correct)

Hi all,

My mom's super visa application was refused recently (Jan 18) with following reasoning,
Not meeting the eligibility requirement for a super visa: Client is applying from within Canada.

However above reasoning is not factual, when the application was submitted she was in India (her home country, passport stamped page was submitted with application) and is currently in India awaiting the result. (She recently visited Canada but went back to India and after few days of her arrival I applied for her super visa)
I double checked the submitted application summary and supporting documents to ensure that I didn't make a mistake while submitting her application which is not the case.

My question is if anyone faced this type of scenario in the past or anything similar where refusal reason was incorrect and what could be my next steps. I am planning to submit a webform with a request to reconsider with proper documentation.

Any response, comments will be appreciated.

You can ask for reconsideration through webform but there are no timelines for reconsideration so sometimes easier to reapply. Did you meet LICO, passed medical and had health insurance.

Thanks for responding, yes met all those requirements. My mom had a super visa in the past but it expired along with her passport expiry date so we applied again after she went back home. I will submit web form and call IRCC to see if they accept reconsideration. Can do a new application but thinking it might be be more time consuming :(

How long did she visit Canada and when did she return home? How long has she spent at home? There also could be concerns that she is attempting to live in Canada.

I submitted her application a week after she went back home as we wanted to have visa process done for my parents for them to travel again after few months. Regarding attempting to live in Canada, isn’t that the point of super visa to allow parents to stay for longer periods of time (within authorized limits)? We are 3 siblings (citizens here) and my parents are alone back home so they visit us often on super visa. I wonder if this is just a case where visa officer overlooked application submission date and her return back home date? Have you heard of any similar scenarios where this type of refusal reasoning was related to concerns of trying to live in Canada?

A supervisa allows for longer visit but like most visitors you are expected to return home and reestablish your life and not try to visit again right away. Supervisa doesn’t allow a permanent move so IRCC does want to see they have a home and life to return to after their visit in Canada ends. Would order GCMS notes to hopefully get more details as to why supervisa was denied.

Supervisa is still a temporary visa . Not permanent and they always had to show ties to return home . Thats why there’s an expiration date
Having everyone else deciding to move to Canada is mostly irrelevant. That was a choice that was made . And adding it should have been part of the discussion amongst the siblings when everyone decided to immigrate and leave the parents . Not an afterthought.

And no, as mentioned they can’t live in Canada . If they were able they’d have a PR card

In the last ten years how much time have they spend in there home country ?
And how much time in Canada ?
