Super Visa on Foreign Income

Hello Everyone!

I have a question around super visa process. If I declare my foreign income in my Canadian tax fillings, can I use that income as basis for sponsoring my mother to apply for a super visa?

To prove, I can provide:

- Employment Letter
- Salary slips
- Bank Statements
- Income tax return from both the countries where the income is declared and taxes paid accordingly.

My concern is that since I am outside Canada and earning out side Canada as well, can there be issues? Especially since the income is not from a Canadian employer and the salary is credited to my bank account in the country of my citizenship (India). I am planning to apply for the super visa early next year and by that time I should have started receiving my salary in my Canadian bank account for at least 4 to 5 months.

Please advise.

Thanks.

Do you have a CRA NOA that shows the required minimum income? You can use foreign income provided it was declared as worldwide income in your CRA return. IRCC will want to see an NOA with your application.

Perfect! Thanks so much for your quick response.
I am a freenlancer, I got my permanent residency earlier this year but I travelled to my home country in September for few months, so most of my income/ salary is still credited in my home country’s bank account. I definitely intend to show whatever I earned while my stay in Canada for this financial year but most of my income is during my stay in home country.

Do I also need to transfer the money to Canada to show the earning while I was there or can I just put the number and pay the tax?

Also I plan on traveling to Canada in Feb, would it be all right to apply for my Mother’s super visa while I am outside of Canada?

Thanks so much for your help!

You need an NOA to apply. If you are going to be filing taxes for the first time, you will not have an NOA by Feb. You cannot apply from outside of Canada. You must be living in Canada to qualify as a sponsor.

Thanks for getting back so quickly.
It will be my 2nd year filing taxes in Canada, so I showed my foreign income for last year as well.
I’ll check how to get an NOA, do you know how long would it take now that I already filed taxes last year?

I'm not sure I understand your question. If you filed your taxes last year then you would have already received your NOA.

Make sure you hold off applying until you are back in Canada. Ideally wait a few months after you have returned before you apply.

That was really helpful, I appreciate you being so kind. I’ll wait until I am back and then apply as you suggested. Thanks so much!

It seems unclear whether you were ever a tax resident in Canada and what your taxable income was if you were. Just a warning that a supervisa does not allow your parent to move to Canada as it appears you may be trying to do. They can visit if they can qualify and purchase supervisa insurance every year but are expected to return home at a certain point.
