Hello,

My study permit has expired and I lost my status now. I had applied for a study permit extension and I was not at all expecting it to be refused because of the medical surveillance that we could not do years ago (I used to have asthma when I was younger but I do not have it anymore). I am still in the 90 days frame and I can still apply for a study permit but I will need to do the surveillance first. I am willing to do it, however, I think it will take long before hospitals give us appointments and I’m afraid it will exceed the time frame given. I don’t know where and how can I ask for a new appointment since I missed the old one. What can I do? I want to continue studying.

Do you mean they want you to take a medical? Surveillance is for those who have shown signs of TB. Asthma is a chronic condition that doesn't go away. Follow the instructions to book the medical. No one can tell you when you will get your appointment but you have to call different facilities/doctors etc.

If study permit expired and no status, you cannot study anymore. You then have to restore status and reapply with updated medical. You cannot study until permit is approved.

Think the issue is that you were not compliant with the medical surveillance you were required to do when you arrived on your 1st study permit so not compliant with the terms of your study permit.

So did you do the medical surveillance appointment when you arrived as you were told to do? If not you were in violation of your study permit. Call and get a new appointment. If you study permit expired then you cannot study until approved.Talk to your international advisor at your school. When did your study permit expire?

I did not, as I didn't think it was necessary and it was a mistake. My study permit expired approximately 2 weeks ago, and I am currently talking with my international advisor at my school.

Just because you didn't think it was necessary didn't mean that you could just skip it. IRCC told you to do it. So you have to stop studying and cannot study (and work) until study permit is approved. Once you have completed the medical surveillance then restore status (must be within 90 days of expiry) and reapply.

I understand. Should I wait for the hospital to call me or should I apply now for a new study permit (I still haven’t), and attach a letter indicating that I am waiting for the medical surveillance appointment ? IRCC told me to wait for the hospital to give me an appointment, but if I wait for it, I’m afraid I would exceed the 90 days frame.

Once you have completed the medical surveillance then restore status (must be within 90 days of expiry) and reapply. Can't you call and make your own appointment. If past 90 days then cannot restore status from within Canada, and will need to leave and apply Outland. Since you you are without status and cannot study may want to apply for a visitor record to maintain status. Get a lawyer too.
