Study permit for Minor

Kindly advise me, I am applying for open study permit for my minor children. My wife is in Quebec as a Temporary foreign worker with specific-employer work permit, i have an open work permit. I am applying for open study permit for the children. Do i need to do Quebec CSQ for the minor children.

Thanks. I have an open work permit, I am looking for a way to avoid the CAQ, on IRCC website minor from primary to secondary school is exempted from PAL/TAL but since my spouse is living and working on Closed work permit in Quebec i am afraid the visa officer may expect the children school where their mother is working and that would warrant applying for CAQ. or am i just entertaining unnecessary fear pls someone should advice me.

You need CAQ. Quebec has its own rules.

Thanks once again for your time well appreciated.
I had applied before for open study permit and it was refused based on letter of consent not signed by a witness and my spouse passport not included , nothing of CAQ was mentioned in the refusal letter. My understanding of open permit study is that the application is on me who have open work permit and I can work anywhere in Canada and my children too can attend any school. But for the fact that my spouse is in closed work permit in Quebec, I just want to know if the visa officer in his own prerogative could be expecting us to settle in Quebec and does he has the right to judge our application bas on his insinuation. Thanks all I will appreciate feed backs from you and others who has experienced such.

Spouse is working in Quebec and Quebec has its own immigration laws. You need CAQ to apply for a study permit. Child may be eligible to study based on spouse’s closed work permit and she works in Quebec. It is not based on your permit and ability to work anywhere. You are only working in Canada because of your spouse. So yes, Quebec and IRCC have the right because if it wasn’t for spouse working in Quebec, you would not have a permit and child would not get to study in Canada. Get the CAQ.

The whole point of your OWP and study permit for your child are family reunification with primary applicant. Your plans should be to join your spouse in Quebec with your child. If you don’t want to live in Quebec wait until your spouse gets PGWP (if they qualify) and gets a job outside Quebec and then apply to join her at that point if you qualify. If you attempt to move outside Quebec with your child I would be prepared to explain the what exceptional circumstances required you to leave Quebec and proof that you did try to establish yourself in Quebec first. Also why they child could not stay in Quebec with their parent even if you were unable to find employment in Quebec (with proof) and moved to another province for work.
