Hi all,

My friend applied for his study permit extension and after 11 months of waiting, the result came back with refusal from IRCC.

This is the second time that his study permit extension application got refusal.

The first time was a few years ago. At that time, refusal letter states he had 90 days to apply for status restoreation, which he did and successfully restored his student status.

A month before that study permit expired, he applied for another extension and got refusal. Refusal letter this time doesn’t say he has 90 days to resore status. Instead, it says he needs to leave Canada forthwith.

Anyone here happens to know if he still has 90 days to restore his status even the letter doesn’t say so.

Just note that my friend was a full time student when he got the refusal decision. I think somehow the immigration officer that processed his case thinks his program was already finished. He was supposed to complete the program in 2021 but due to COVID and few other things, he couldn’t enroll some classes till this semester.

This letter is in reference to your application for temporary residence. Based on your application and accompanying documentation that you have provided, I have carefully considered all information and I am not satisfied that you meet the requirements of the Immigration and Refugee Protection Act and Regulations. Your application as requested is therefore refused.

You no longer meet R216(1)(e) as the completion date for the program you were applying for has passed.

Pursuant to section R 216 (1) Subject to subsections (2) and (3), an officer shall issue a study permit to a foreign national if, following an examination, it is established that the foreign national

(a) applied for it in accordance with this Part;

(b) will leave Canada by the end of the period authorized for their stay under Division 2 of Part 9;

(c) meets the requirements of this Part;

(d) meets the requirements of subsections 30(2) and (3), if they must submit to a medical examination under paragraph 16(2)(b) of the Act; and

(e) has been accepted to undertake a program of study at a designated learning institution.

Pursuant to section 183(5)(a) of the Immigration and Refugee Protection Regulations, your temporary resident status has expired. You are now a person without status in Canada and as such, you are required to leave Canada forthwith. Failure to do so could result in enforcement action being taken against you.
