I am hoping to apply under the common-law sponsorship. From my understanding, any temporary separations start AFTER 365 days of living together.
My partner and I moved in together on September 2020, and it’s been a year and a month now.
The thing is- I was still working in Canada (virtually) while i was PHYSICALLY abroad in the UK from 27th Feb to 6th June, but it was because of my studies. Would I be able to apply under common-law? I have all the other evidence- all my bills in Canada were to this address, I was on the lease for it, my partner and I were connected with each other continuously etc etc.
CRA declares that “You are still considered to have a spouse or common-law partner if you were separated involuntarily (not because of a breakdown in your relationship). An involuntary separation could happen when one spouse or common-law partner is living away for work, school, or health reasons or is incarcerated.”
This could count as involuntary separation, yes?
MOREOVER, while we didn’t live together under the same lease, my partner basically lived with me throughout the pandemic... I have evidence of things being delivered to us at my old house... so we “cohabited” for 365 days+ (i dont know how to prove this, though- would letters from friends/ ex-roommate work?)... but were on the lease starting sept 2020. The house we live in is owned by their parents, I was living in it before the lease in our current apartment (parents’ house) started but I had another lease before sept 2020.
Any help would be appreciated!
