My OLD POST:

I am On Study Permit in Canada since 23 August 2012, joined already classes for Fall Semester 2012 from September 5. My Husband did not applied with my application for TRV or OWP to accompany with me because he previously applied for Immigration under Federal skilled worker and got refused in 2010, so we were scared that if we both apply together, may be none of us will get visa. This theory proven to be true and I got my study permit without any problem.
But here new phase of depression started for me since I left my spouse back home
I showed in my own account ($25232/=) as prove of fund, including ($7382/=) First semester fee and ($3179/=) 4 month accommodation fee, after paying both of them there is now ($14671/=) only remaining in my account. This amount of ($14671) has also been transferred in my account in Canada.
My Question is me and my husband is exhausted thinking about which application my husband should submit to Visa office so that he can join me as soon as possible in Canada.
1: If we go for TRV made outside of Canada he has only my previous bank statement and previous balance certificate in hand of my account (which I used at the time of apply my study permit) as a proof of funds plus + weak point of refusal FSW application history.
2: If we go for open work permit, then most of the members on this forum are not encouraging to submit OWP from the home country and also this OWP form is very much difficult to fill as all questions are related to the arranged employment.
What plan we should follow..any Idea...?
I cannot concentrate on studies and feels in the middle of nowhere.
Experts and members gone through the same experience please reply.
My Husband TRV got rejected and I am only in the second month of my studies and already cannot focus on my studies and not bringing good marks in Quizes and mid terms.!!! I have now no intention to continuous my studies or staying here in canada, unless somebody shows me the way how to arrange my husband to join me.
Reasons in Refusal Letter:
1:You will not leave canada at the end of your stay
2:Your Travel History
3:Limited Employment prospects in the country of Citizenship
Q1: what can I do now. should i see some lawyer in toronto..? is there any suggestion for lawyer who has a successfull history in handeling my kind of cases???
Q2: My study permit is till August 2013
If I ask my university that I want to quit from this semester and I need time to think whether or not to join studies again from next semester...do I have to leave immediately or I can find some solution for few weeks and then leave because every second living without my husband is a burden on me now.
Q2: "What is Job offered after LMO approved" because I heard that new students cannot work full time then how does this term works?
Pleazzzz HELP....

Sorry to hear that.

You should speak to your school advisor. I doubt even if you want to quit studying, your tuition for this semester will not be refunded. And as a student, you are not allowed to work full time during school. Only during school breaks, you are allowed to work full time. If you want to work off campus, you need to apply for off-campus work permit. You are only eligible after 6 months being a full time student. So you are not yet eligible. You also need to maintain certain grade at school in order to be eligible.

I am not familiar with spousal OWP and I hope some senior members would chime in. But the fund you have seems to be way too low.....

Your husband have to show strong home ties all three of following.............

Property and (Job OR Business) and Blood relations............. in order to get TRV..................

1. Lawyer will only make money from you , in my opinion don't ever take such risk unless u are sure........
2. Freezing or Quitting the semester is the University policy , but make sure that it will make the extension of your study permit more difficult.
3. LMO works when you are on POST GRADUATE work permit OR PR. You can't work outside campus for 6 months + 45 days (OCWP) processing time............

Travel history? Have your hubby ever traveled out of his country?

you will not leave canada at the end of your stay is a generalized statement.... refusal reasons are tick marked .....travel history and limited job prospects of his selected course are the main reasons....if he was refused based on no home ties..reason could be worded like home ties in your home of residence

please double confirm his refusal reasons for us....because i have seen a refusal letter of my friend....reasons are tick marked
