Hi Everyone,

I was wondering if I can help my nephew to go back home safely after his study visa expires. His visa will expire end of next month but he is not willing to leave the country. How can I force him to leave and come back properly with correct papers?

if he doesnt wanna leave till his visa expired and you cannot make him go home.

1. he would need to apply for change of status as a visitor to maintain legal status in Canada (before his study permit expired)
He can stay in Canada as implied status till DM.

2.if his visitor visa is rejected then he would receive a letter from CIC that he need to leave the country by certain time .
Then he must leave the county.

That's all I can think , hope other member would give you more idea.
if he would get rejected visitor visa, if might affect hie next visa( any visa) application.

if he holds TRV, he can stay in Canada till his TRV expired (not sure about this though)

You could report him to CIC if he isn't studying and has violated the terms of his work permit.

However if you report him to CIC and he's removed from Canada, then he'll most likely never get a study permit again.
