Student to Visitor to Student Extension possibilities.

Hi, I am writing to ask for help if someone has a similar case and/or has knowledge on how I can proceed.

I came as a student in 2022, my studies should’ve ended Feb 2023 but I opted to upgrade for COOP (until Dec 2023). At the time my permit expires at May 2023, my immigration consultant informed me that an LMIA is available and work permit is on the process(Feb2023) and that I qualify under maintained status whereas I didn’t extend my student permit(May 2023). So permit expired and I still asked if there’s a need to apply for extension as i’m worried about my status, again they said it’s okay as the permit is on process. I didn’t know better and just believed what they said without asking for any proof. Came Oct 2023, it was confirmed by the same IC that the work permit application didn’t come through as the employer didn’t cooperate with the requirements. I was dismayed and frustrated as I realized I am out of status. We looked for another consultant and she was able to submit a visitor visa application and I got restored but as a Visitor(until April 2024). I was still adamant to finish my course that I asked for extension from my school and granted an extension until July 2024. I asked again my consultant if she can shift my visitor status to student and work(coop) permit through extension applications and unfortunately my student permit extension was refused the other day. My work(coop) permit is still ongoing but i’m not confident on positive results as the SP is already refused.

I am planning to re-apply but I’m not sure if that’s the right way to do it as the refusal letter indicated that I am not eligible to apply within Canada. Has anyone have a similar case? Please I need some inputs. Thank you.

You were never eligible for a study permit extension because you let your study permit expire. You need to apply for a new study permit with CO-OP. You couldn’t convert a visitor to study permit. You must stop studying now. You also need to meet new IRCC funding requirements for study permits.

Thanks for the input. Does that mean I can apply for a new permit Study Permit with COOP OUTSIDE Canada, using my extension letters from school? Or I need to ask for another LOA and such?

You will need a new LOA to apply. Just so you know, you will not be eligible for a PGWP. When did you stop your studies because your permit expired more than 6 months ago?

Just to verify my understanding, I can apply for Student Permit with COOP “outside” Canada even while in Canada as Visitor right?

Yes, you can apply as a visitor but processed outland. You will need to show proof of tuition payment and $21k in bank account. You may want to include a very well written explanation of why you want to complete your program more than a year after dropping out.
