Hi,

I've got a very bad situation going on. I claimed political asylum in Canada in October 2019, but in November 20 2019 I withdrew the application and returned back to Europe. I claimed the asylum because I was being followed by the secret police for four years. I will not get into details but I withdrew the application because I had no idea that it takes that long for it to be processed and decided, I did not know that nobody will actually care. I left to another country in the EU where I am working now. I received the exclusion order for one year when departing Canada. The immigration officer told me that I will be able to return to Canada again, once I have the visa etc.

I have an opportunity to study at university in Canada and I fulfil all the requirements, BUT I claimed the asylum and have the exclusion order.

What are the chances that my student visa application will be approved when I file the ARC too?

Has anyone any experience with this situation? I would really like to return to Canada. I abided all laws when I claimed the asylum and when deporting. I do not have any criminal history.

How can I prove my strong ties to my home country, where I can't live due to being persecuted from the government?

Is there another way, how I could get to Canada with being honest about my situation and not lying about "strong ties to my home country"?

You will have a hard time being approved.

I live in the UK now (for about 4 years), I studied here in the secondary school but then had to do homeschooling because of the family problems with the government of my home country. The Canadian universities accept me as a homeschooled applicant, but it is impossible to apply to university here in the UK as a homeschooled student. That's the reason I want to study in Canada. If I will get the settled status, here in the UK, or permanent residency, would that be enough to prove I will come back? I lived in many EU countries, because I was forced to keep moving. I know that I made a mistake with the political asylum and I withdrew the application in 1,5 months. My case was never at the hearing neither the refugee interview. They do not know why I claimed it.

Because you have an exclusion order.

Applying before the exclusion order ends will result in a denial. Nothing much you can do.

That’s why people should think long and hard before doing any asylum claim , be because it can have long term repercussions

If I apply with ARC, will it make my future attempts to obtain the visa more difficult! If they refuse me now?

ARCs are for strong, compelling reasons to have to come to Canada. Wanting to study in Canada doesn't really qualify.

Realistically your only option is to qualify and apply for permanent residency through an economic immigration program like Express Entry.

You can certainly try applying for the ARC - given your departure from Canada was so recent, it may be quite challenging for it to be approved. If the ARC is approved, your chances of getting a study permit are very difficult to guess but are likely going to be very low given the past refugee claim. I would honestly forget about the study permit route and focus on getting the work experience, education and savings to apply to immigrate to Canada at a later date. Any temporary visa (work permit, study permit, visitor visa) is almost certainly going to be refused as a result of the refugee claim.

I am a student of art and history, do not have much of working experience. Can I still be viewed in the express entry application as a dependent child ( I am 19 years old)? Also, If my mum is going to apply for the express entry, how long should we wait in order to get approved? Can we apply for the ARC and express entry at the same time?

Also, if I would be viewed as a dependent, could I study at uni? And what sort of visa would I get, if my mum would get the express entry visa?

Are you sure your mom will have enough points to be invited? It's not enough to simply qualify - you also have to be invited, and that's based on CRS points. Since you're 19, your mom may be too old to get any points for age and that will be a big roadblock.

If she does somehow qualify and be invited, then yes, you will be considered a dependent (assuming you're single) till the age of 22. After 22, you won't (except in very limited cases, none of which appear to be applicable)

If your mother did become a Permanent Resident, you would be a PR as well, and can study/work/do whatever.
 
You're right, she doesn't have enough points..

Yeah, then your only realistic option is to wait a few years and try and qualify for EE yourself. Your withdrawn asylum claim has essentially closed the door on any temporary visa.

There is one other option - if you marry a Canadian citizen (or are in a long term relationship) they can sponsor you as well - but obviously that marriage needs to be genuine. Don't think of trying to do a paper marriage just for PR.
