Still a visitor but found a sponsor as a live in care giver

Hello.

I have been in Canada for 3.5 years, and was in a common-law relationship for 3 years. The relationship didnt work out so the common-law application never got filed. I found a couple who would sponsor me as thri live-in caregiver.... However, what could I do while they are trying to figure out how to sponsor me? My visitor visa is expiring in 2 days, and should i apply for visitor visa extension? What would be the reason for me to apply it? To obtain a work permit? I dont think Immigration like this idea right??? Please help!!!!!!!!!!!!!!!!!!!!!!!

Yes - you'll need submit an application to restore your visitor visa before your current visa expires.

I don't know what you should say in that extension.

Hi. I will extend my visitor visa before it expires. I just wonder if it is the best way to stay in Canada at the moment while my sponsors doing the paper work for me??

I don't see any other way for you to stay in Canada legally. You don't qualify to apply for a work permit yet - so the visitor visa is your only choice (apart from leaving Canada and returning home).

I assume you meet either the experience or education criteria to be a live-in caregiver?

Book your flight out. Immediately. The CIC website says to apply before 30 days of expiry so I will hold back the obvious about you waiting too long...and just say that it is too late. You will need to leave because 1 day is not enough despite the implied status thing. I am assuming the 30 day thing is a worst case scenario for the processing times.

Maybe as a suggestion, look into getting a Greyhound bus across the border to Montana, US and stay in a hostel/motel while you wait for your work permit to go through? Even then, I think it takes a very long time so you'll be there a good long time waiting.

Do your research.

The 30 days is a guideline. As long as there is at least one day left on the visitors visa before the extension is submitted, you have implied status until a decision on the extension is made.

I got a refusal letter today from Immigration. I did not mention that my sponsorship was in the process , i just stated that I would like to stay for 2 more months. The refusal letter states that ".........you must leave Canada immediately...", and I heard about the 90 days period of leaving the country... is it true? Thanks. Sad .

You should leave in 30 days.

The 90 days is for restoration of status. Restoration of status won't work for you since you've been asked to leave.

There's no appeal process. You need to leave Canada and continue the application process from outside of Canada.
