If he has been continuously enrolled in school since before the age of 22 then he is still classified as your fathers dependent, or so I would assume. I could be mistaken about this as I don't know a whole lot about parental sponsorships.

I would also caution you that currently the parental sponsorship stream is closed and no new applications are being accepted. I do not know when that stream will again open up.

You assumed correctly regarding the brother's being a dependent of father assuming he has been continuing his education since before 22 and is not married or common law.

The question I don't know is whether the OP also want the brother to come along and land as PR with his father or not.

If OP wants his brother to come as dependent of father and land as PR, the brother will have a tough time keeping up his full time education and stay single for a few more years. The brother must maintain his education for the entire duration of the PR parental sponsorship. He cannot skip or take a semester break from schooling.

I would love to sponsor my brother and try my luck to see if I can make it next year to submit application for my parents....your date of birth gets locked down once the they issue you the AOR for the application that's what I heard...the problem is you cannot add dependent who is more than 22 years old....I think thats what I read in the cic website.....he will be in the school for next 3 -4 years....but I thought adding him is not an option anymore since the new law......maybe I am incorrect?

Part of the new law hasn't come into effect yet. The allowing those 19 and older being unable to be declared dependent regardless of education. This can change come jan2015. Just have to wait and see.

You can add him to the application but since he will be in school next 3-4 years, chances are he will be finished before PR is done. So you would have to update application removing your brother from the application.
