Stay or Leave before Getting ITA

My current situation is as fellow:
1. My current EE score is 440. I tried another language test to boost my score last month but didn't work out. I am planning for another test soon next week. If I can get 0.5 more point for speaking I can reach to 460.

2. My work permit expires next week. But I researched and figured out that if I apply for restoration then I can stay here for another 90 days before the result no matter approved or not. Which will allow another 90 days for EE.

3. However, from now and next 90 days I can't work and therefore no income

Now I have two ways to go:
One, is stay in Canada, if I didn't get ITA within next 90 days I might choose to change status to visitor or student. But this way, I will need financial support from my parents.
Two, is go back to my country. And work there for one year or so, so I can continue to apply under EE, and after one year my score will bump up about 50 points because oversea work experience.

5. Now I am just wondering which way is the best option for me. Recent score for cutoff isn't looking gook...... But I heard that there might be a new system for international students so all my friends told me to stay here and keep up. But I am worried that the new system or policy didn't come up within few months or one year, should I better to start oversea work soon.? And if I stay here without income it's a huge cost for my family.

Please please please anyone give me some advise......

Why without income?! Find a job! Anything! Also, Ontario might start sending out invitations again! That is another option. It costs 1500 CAD but I think it is worth it.

I assume the issue is your SIN that starts with a "9" expires on the day your work permit expires?

I believe (might want to clarify this) if you are in a current job, you can continue to work as long as you are in the process of applying for an extension (get it in quick). At least ... I know people who have had an expired work permit, but were still working while applying for the extension, AND while waiting on an ITA. Incidently when the work permit was renewed... it listed the date requested as the start date.

Also, your health card likely expires when your work permit does as well. I would recommend getting some basic coverage in case something bad happens.

Leaving Canada to gain one year of foreign work experience is, I think, actually a really interesting point. I was thinking about that too, since it does bump up the score significantly and this is only option I see besides applying for OINP, which has recently stopped sending PT's.

However, if you leave Canada and work one year abroad, will your Canadian work experience still be valid?

No, you can't. You're on implied status only if you applied for another work permit while your old work permit is still valid. Otherwise you're out of status and can't work anymore.

It's very likely that they were working illegally. Illegal work is one of the reasons for rejection of PR application.

That's what I mean, his work permit doesn't expire for another week. If he gets the request in before it expires he would be on implied status.

I would definitely agree that you if the work permit expires and you haven't got anything into the system you are out of luck.

Can he apply for an extension for PGWP without having the AOR? The work permit extension will get rejected for sure right while he awaits ITA.

I am in a similar boat with 469 points and PGWP expiring on April 25th....

I might take a leave of absence from work and change my status to visitor..applying for an extension is like gaming the system knowing that my ITA hasn't come in..

Yes, he could work legally on implied status. My friend is working in the same job, her work permit is expired but she applied before expiration. It is not illegal and I know it because she works in a big company and they don't want to get into trouble for such things.

Hi Han,

did you friend apply to extend work permit without ITA/AOR/LMIA??
do you know if her extension application was approved or not?

You can definitely apply for your work permit extension without anything even you know you will be rejected. At least, by doing this, you can buy some time working here legally.

I can share my BOWP timeline with you.
Mine was expired November last year.
I applied extension without anything. And I received my AOR this January and I attached to my work permit extension application. Luckily VO accepted all the doc and mine new work permit application got approaved last Friday. One year.

So you should try, you will have a chance.

Question... so your work permit (was it PGWP?) was expired in November, so you applied for extension without anything before your visa expiry. And then you received ITA during your implied status? or you got ITA before your visa expiry but you just had no AOR to submit along with your extension application?

Also, if you received your AOR after you submitted BOWP application, how did you attach your AOR later?

No, she applied for WP extension with AOR. During processing time she was able to continue working because she was on implied status. The same thing happened to me! I applied for study permit extension and I was perfectly able to continue registering for next terms and so on during the time I was waiting for a decision on my application. Implied status is a legal status.
