Hi all,

I am trying to sponsor my common-law partner and I was just reading through the sponsor guide. With regards to the forms that I have to complete it says:

"The statutory declaration of common-law (IMM 5490), to be completed only if you have a co-signer and he or she is your common-law partner"

So since we do not have a co-signer, does this really mean we do not have to submit the statutory declaration form for our common-law relationship? We did not notice this before so we actually got someone to sign it. Since we have already filled it in, would it be beneficial to include it or should we not send it in? It seems a bit odd that they would not require this form even if we did not have a co-signer.

You don't need it. It is for cases where you are sponsoring a family member other than your common-law spouse and are using the spouse as a co-signer. That said, therre's no harm in sending it in. At worst, they'll just send it back.
