STATUS RESTORATION REFUSED - COMPLICATED SITUATION

Hello everyone,

I'm an international student here in Canada since 2012 on a study permit, and entered with my wife (TRV) and 3 children (one has study permit, one has TRV, one is U.S. citizen.

Upon our first entry, I was issued the study permit at the port of entry (expiration date: 01 SEP 2016), and printed on it "ACCOMPANYING FAMILY MEMBERS: my wife and 3 children names and date of births"

Under the stamp of entry on my wife's, child's with TRV, and the American child passports, the officer wrote "V 01 SEP 2016 and my study permit number". The third child was issued a study permit (expiration date: 21 MAY 2016)

During the past four years, we traveled to our home country and the U.S. several times. My wife's passport along with the first two children's passport mentioned above were stamped for entry 4 times after the first entry back in 2012. Out of these four stamps, only one has the same information "01 SEP 2016, my study permit number" of the first entry. On our last entry (10 SEP 2015), their passports were stamped and nothing was written under the stamp.

I've been very busy during those years and mistakingly been thinking that all of our visas' expire on the same date (01 SEP 2016). and their status is related to mine since they were listed on my study permit as accompanying family members. I also had no idea what so ever about "VISITOR RECORD".

On 01 SEP 2016, I applied online to extend my study permit and my family's status. In the questioner, I answered that my wife and two children were out of status and need restoration of status based on the expiration dates of their visas. On the application forms IMM5709, I indicated that they have remained beyond the validity of their status.

My study permit extension was approved, however, their extension to stay was rejected and they were asked to leave the country.

Now, my question is, did I make a mistake when I answered the questioner and filled the application forms? Was their status valid until 01 SEP 2016 as written under 2 out of 5 entry stamps?
Finally, what should I do now to fix the problem.

Hi

Visitor status ends when a person leaves Canada. It doesn't matter how long they were granted on previous stays. Your family was given 6 months on their last entry in Sept 2015, so they have been out of status since March. They are long past being able to restore their statuses.

Your family needs to leave Canada. There is no way they can regain legal status within Canada.
